OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF <br /> AGENDA <br /> <br />NONE <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />Sam Light, City Attorney, distributed copies of a complaint that was filed today <br />regarding the Northwest Parkway Agreement. He explained that the defendant's in the <br />case include all four of the parties that were signatories to the Agreement. He stated that <br />Council passed Ordinance No. 1301, regarding annexation of the Warembourg property, <br />at the last City Council meeting, on the condition that an executed Annexation <br />Agreement is presente'd to the Council by tonight's meeting. He stated that, unfortunately, <br />that Agreement has not yet been executed due to scheduling issues. He explained that he <br />does not anticipate any problems in finalizing the Agreement, however, he requested <br />direction from Council on what they would like to do with this issue. <br /> <br />Mayer asked Light whether this would require a motion by Council. <br /> <br />Light explained that the best way to protect the City's interest, without repealing the <br />Ordinance, would be to consider a motion for reconsideration and have the Ordinance set <br />for reconsideration at the next City Council meeting. <br /> <br />Davidson moved that Council reconsider Ordinance No. 1301, Series 1999, at the AugUst <br />3, 1999 City Council meeting, seconded by Howard. All in favor. <br /> <br />CITY ADMINISTRATOR'S REPORT <br /> <br />Bill Simmons, City Administrator, distributed copies of correspondence he received <br />regarding the Northwest Parkway Project. He explained that the Northwest Parkway <br />Public Highway Authority met for the first time on July 6, 1999. The Intergovernmental <br />Agreement that was executed earlier this year called upon the Public Highway Authority <br />to execute its consent and agree to be bound by the requirements of the <br />Intergovernmental Agreement. That consent was to be delivered and enforceable by the <br />signatories to the Intergovernmental Agreement. He stated that the City of Louisville has <br />received a resolution, which states that the Authority will exercise its power and construct <br />the project in accordance with the Intergovernmental Agreement, and agrees to be bound <br />by the requirements of the Intergovernmental Agreement. He stated that there would not <br />be a work session on Tuesday, July 27. <br /> <br />COUNCIL COMMENTS AND COMMITTEE REPORTS <br /> <br />Keany requested additional speed limit enforcement on Lafayette Street between Via <br />Appia and Lincoln. <br /> <br />8 <br /> <br /> <br />
