Sisk proposed that Council adopt Ordinance No. 1306, Series 1999 as an emergency <br />Ordinance, because the applications received within the next thirty days would have an <br />advantage. <br /> <br />Lathrop questioned whether anyone who is currently in the process and not ready to <br />apply for a building permit would be able to do so within the next thirty days. He felt that <br />this would be penalizing the individuals who have acted in reliance on the existing fee <br />structure and are within a few weeks of applying for their permit. He explained that, for <br />this reason, he would not support passing this as an emergency Ordinance. <br /> <br />Sam Light, City Attorney, explained that Section 2 of the Ordinance would then need to <br />be revised accordingly. In addition, he reminded Council that an emergency Ordinance <br />requires an affirmative vote from three-quarters of the members of Council, which would <br />be six of the seven members. <br /> <br />Mayer asked Light for clarification that an emergency Ordinance would require three- <br />fourths of the vote of the entire elected Council, not just the members present. <br /> <br />Light replied, yes. <br /> <br />Mayer asked Light what would occur if the ordinance were not passed as an emergency, <br />specifically whether Council could then vote to adopt it as a regular ordinance. <br /> <br />Light replied that the motion could be amended to state that the ordinance, if not passed <br />as an emergency, would take effect as adopted. <br /> <br />Sisk moved that Council approve Ordinance No. 1306, Series 1999 - An Ordinance <br />Increasing the Water Tap Fees in the City of Louisville, Colorado, as an emergency <br />Ordinance, which allows the Ordinance to become effective as of today, or, if not passed <br />as an emergency, would take effect as adopted, seconded by Mayer. <br /> <br />Davidson offered a friendly amendment that Council adopt the Ordinance, as written, <br />without the emergency ordinance amendment. <br /> <br />Friendly amendment was accepted by Sisk and Mayer. <br /> <br />Roll call was taken.
