Insurance shall be maintained to cover the content of productions which are cablecast 011 the access channel in, at minimum, the following areas: libel and slander; copyright or trademark infringement; infliction of emotional distress, invasion of privacy; plagiarism; misuse of musical or literary materials. This policy shall not be required to cover individual access producers. E. CITY AS CO-INSURED OR ADDITIONAL INSURED. The City shall be I named as an co-insured or additional insured on all aforementioned insurance coverages. except for \votkcrs cOl11pensation. The policies shall provide that no cancellation, major change in coverage or expiration may be affected by the insurance company or CCTV without first giving the City thirty (30) days written notice prior to the effective date of such cancellation or change in coverage. Any insurance or self-insurance maintained by the City, its officers, agents, employees, or volunteers shall be in excess of CCTV' s insurance and shall not contribute to it. F. NOTIFICA nON OF COVERAGE. CCTV shall file with the City proof of insurance coverage as fo11O\\o's: (1) Comprehensive Liability upon or prior to the effective date of this Agreement; (2) Workers' Compensation upon commencement of the employment of any I employee; (3) Commercial Prope11veEftHprnelTt: insurance upon th~ issuance Jhcn::ofHit' a€ilHisitioH-ef-afl~'-equi-'j'lftWHt:; and (4) cablecaster's error and omission insurance within thirty (30) days of the effective date of this Agreement, with coverage effective as of the effective date of this Agreement. The City reserves the right to request and receive a certified copy of any policy and any endorsement thereto. I SECTION 12+. NON-DISCRIMINATION IN EMPLOYMENT AND SERVICE. CCTV shall not discriminate against any person, employee or applicant for employment or subcontractor on the basis of race, color, creed, religion, sex, sexual preference, marital status, ancestry, national origin or physical or mental handicap. CCTV also shall not discriminate in the delivery of services on the basis on race, color, creed, religion, sex, sexual preference, marital status, an ancestry, national origin or physical or mental handicap. SECTION 13. POLITICAL ACTIVITY. I SECTION 142-. INDEPENDENT CONTRACTOR. The status of CCTV shall be that of an independent contractor and it is not intended, nor shall it be constmed, that CCTV or its employees are employees or agents of the City for purposes of unemployment compensation, workers' compensation, or of any purpose whatsoever. If in the performance of this Agreement any third persons are employed by CeTY, such persons shall be entirely and exclusively under the control, direction and supervision of CCTV, and all terms of employment, including hours, \vages, working conditions, discipline, hiring and discharging or any other term of employment 9
