<br />Open Space. Automobiles and other conveyances may not be parked, abandoned, or <br />otherwise remain in Open Space parking lots during closed hours, except as follows: <br /> 1. During attendance at a function conducted or sponsored by of the City; <br /> 2. During attendance at a function which has been issued a permit; <br /> 3. Bya City employee acting in the performance of such employee's duties; <br /> 4. With the prior written consent of the Director; or <br /> 5. In areas as otherwise posted. <br /> Vehicles in violation of this section shall be subject to being towed away at <br /> owner's expense. <br />Sec. 4.04.070. Use of lakes and reservoirs. <br />A. All rules and regulations set forth in this chapter shall also apply to use of such <br /> facilities as public lakes, ponds, streams, reservoirs or other bodies of water <br /> within City-owned Open Space. All persons entering such lakes, ponds, streams, <br /> reservoirs or bodies of water shall abide by the rules and regulations ofthe City, <br /> as provided in this chapter and elsewhere in this code, the rules and regulations <br /> promulgated by the Director, and the instructions and directions of duly <br /> authorized agents, employees, or law enforcement officers ofthe City acting in <br /> their official capacity. The rules and regulations shall be posted at such locations <br /> as to provide notice to the citizens and members of the public using such <br /> facilities. <br />B. Fishing is allowed only in Harper Lake, the Warembourg Fishing Pond, and Lake <br /> Park. State Fishing Laws apply. <br />C. It shall be unlawful to swim, dive, wade, ice skate, or ice fish, on any lake, pond, <br /> stream, reservoir or other body of water within any Open Space area. Except for <br /> Harper Lake, boating is not allowed on any lake, pond, stream, reservoir or other <br /> body of water within any Open Space. All boats must have valid City permits for <br /> use in Harper Lake. <br />Sec. 4.04.080. Administrative rules and regulations. <br /> The Director is authorized to adopt administrative rules and regulations that <br />supplement the provisions ofthis chapter, when such rules or regulations are determined <br />necessary for repairs, wildlife, vegetation or public safety concerns. All persons shall <br />comply with such rules and regulations, which shall take effect upon their adoption by the <br />Director. The Director shall, within two days of adopting any administrative rules or <br />regulations pursuant to this section, send notification to the City Council of such action. <br />The City Council may, at a regularly scheduled meeting, rescind or modify the rules or <br /> 7 <br />
