Planning Commission <br />Staff Report <br />June 9, 2011 <br />2. That such use/development will lend economic stability, compatible with the <br />character of any surrounding established areas; <br />Staff finds the use and activity as proposed, along with staff conditions, to be compatible <br />with the surrounding established commercial and residential uses. Staff concludes this <br />criterion has been met. <br />3. That the use/development is adequate for the internal efficiency of the proposal, <br />considering the functions of residents, recreation, public access, safety and such <br />factors including storm drainage facilities, sewage and water facilities, grades, <br />dust control and such other factors directly related to public health and <br />convenience; <br />Internal efficiency requirements have been addressed on the proposed SRU site plan as <br />adequate internal pedestrian circulation has been provided. Staff concludes this criterion <br />has been met. <br />4. That external effects of the proposal are controlled, considering compatibility of <br />land use; movement or congestion of traffic; services, including arrangement of <br />signs and lighting devices as to prevent the occurrence of nuisances; landscaping <br />and other similar features to prevent the littering or accumulation of trash, together <br />with other factors deemed to affect public health, welfare, safety and convenience; <br />The proposed land use appears to be compatible with the commercial and residential <br />nature of this neighborhood as produce sales provide a specialty retail need for the City <br />of Louisville and the Downtown Commercial Core. Staff concludes this criterion has <br />been met. <br />5. That an adequate amount and proper location of pedestrian walks, malls and <br />landscaped spaces to prevent pedestrian use of vehicular ways and parking <br />spaces and to separate pedestrian walks, malls and public transportation loading <br />places from general vehicular circulation facilities. <br />The property is has a sidewalk on the east side of the property; however, the property is <br />missing a sidewalk along the Elm Street (South) frontage. Staff has placed a condition <br />on approval that the sidewalk along Elm Street be provided to the applicant that to agree <br />that this provision has been meet the condition of this criterion. . <br />STAFF RECOMMENDATION: <br />Resolution No. 13, Series 2011, recommends approval by the Planning Commission to <br />consider a special review use (SRU) to allow Altan Alma Organic to operate outdoor <br />vending of agricultural products in the Commercial Community (CC) zone district, with <br />the following conditions: <br />1. The proposed temporary structures may not be constructed until a Floodplain <br />Development Permit is obtained by the Board of Adjustment. <br />5 <br /> <br />
