Staff Updates <br />a. Troy Russ, Planning Director: Designating Road Right-of-Way <br />through Public Land Dedicated to the City as Outlot B of the <br />Davidson Highline Subdivision <br /> History / Background: “Public purpose” dedication made in 1990. <br />o <br />Dedication for the purpose of open space, but also intended to <br />encompass extension of public right of way (Hecla Dr.). <br /> 1989: N. Louisville General PCZD Development Plan – <br />identified property as “open space” with Hecla Dr. crossing it. <br /> The subdivision plat came in 1990, and it made a dedication <br />for “open space.” <br /> Open Space Master Plan 2004: Outlot B is not identified <br />with an open space management zone. <br /> Issue: This land is not properly designated within the open space <br />o <br />zoning designation, according to the city attorney. Question is <br />whether or not the city should permit/grant a right of way easement <br />across this (quasi) open space. <br /> No lands have been zoned “Open Space” at this point in time. Staff <br />o <br />is currently working on ordinance language that will allow Open <br />Space within the City of Louisville to be zoned. <br /> Home Rule Charter Article 15, Section 15-3 (a) states that all <br />o <br />vacant lands owned by the City shall be reviewed by OSAB for a <br />recommendation to City Council regarding if the vacant parcels <br />should be zoned as Open Space or not. <br /> City Attorney has determined that OSAB does not need to act upon <br />o <br />this land because the land is not properly designated as open <br />space. <br /> OSAB, however, may still make a recommendation, but it is <br />not procedurally required. <br /> Outlot B clearly intended to be a trail. Now, a new trail alignment is <br />o <br />proposed, where the trail will meander. Lot 3A owner will provide a <br />trail easement. <br /> Necessary for the right of way: 60’ right of way for Hecla Drive <br />o <br />(approx. 52’ paved), 10’ for dry utility easements (however, <br />permanent easements will be primarily below grade) = total of 70’ <br /> No action taken. <br />o <br />b. Xcel Site <br /> – City Council is currently reviewing and considering possible <br />acquisition of this property. Listed as Property B on the OSAB Candidate <br />Open Space Rubric. <br /> <br />
