City Council <br /> Meeting Minutes <br /> April 5, 2011 <br /> Page 6 of 10 <br /> applied for, and was granted, a one year extension to the original expiration date on <br /> April 6, 2010. The current expiration date for the 940 Main Street final PUD plan is June <br /> 5, 2011. The three year extension has been requested to provide the applicant <br /> sufficient time to secure financing for the project. The only modification to the final PUD <br /> being requested is a three year extension of the approval time. All other aspects of the <br /> original plan approved by City Council, and administratively amended by planning staff, <br /> remain unchanged. Staff recommended approval a three year extension of the <br /> expiration of the final planned unit development plan for Lots 9 -12, Block 1, Louisville <br /> Old Town (940 Main St.), from June 5, 2011 to June 5, 2014 with the following <br /> condition: <br /> 1. The final design and construction of the public right of way on the north side of the <br /> building will comply with the design intent outlined in the Downtown Parking and <br /> Pedestrian Action Plan. <br /> APPLICANT PRESENTATION <br /> Arlin Lehman, 680 Johnson Street, Louisville, CO agreed to landmark the site, which <br /> formerly housed "Joe's Market He reviewed the several improvements and extensive <br /> changes to the building and stated the building can no longer be landmarked for its <br /> historic architecture, other than the facade, but can be landmarked for the social <br /> significance of "Joe's Market He reviewed the challenges with the existing roof and <br /> the proposed new addition's roofline. He noted an electrical permit is needed to <br /> upgrade the Chili Hut property however the Historic Preservation Commission has <br /> required landmarking of the building before any permits can be issued. He requested <br /> Council clarify the building can only be landmarked for social significance and not for <br /> historic architecture. <br /> Planning Director Russ clarified the condition on the PUD has no bearing on the <br /> electrical permits for the Chili Hut or any internal improvements to 940 Main Street, the <br /> Bronze Elk building. They are not in conflict with the PUD and the preservation of the <br /> historic facade was the only condition of the PUD. <br /> COUNCIL COMMENTS <br /> Council asked whether the demolition permit was issued. Planning Director Russ stated <br /> the demolition permit was stayed. The original condition was for landmarking the <br /> facade only. Staff required definition of what needed to be landmarked and worked with <br /> the City Attorney for clarification on whether the original building or the PUD should be <br /> landmarked. Staff recommended the PUD be landmarked. <br /> Mr. Lehman clarified his objection is to the HPC requirement to file an application for <br /> historical preservation within the next six months. He explained they want to make sure <br /> there are no other issues, which may come up as part of the entire project. He <br /> explained the demolition permit was requested to provide two separate doors to two <br />
