The request was initiated by the Louisville Resource Conservation Advisory Board <br />(LRCAB). <br />. The ordinance would amend Chapter 17 of the Louisville Municipal Code to promote <br />recycling. The section would define regulations for the design and placement of refuse <br />and recycling areas in all zone districts that permit multi-family development. <br />. There are three exceptions: <br />1. If there is not sufficient space for the placement of these areas in the development. <br />2. It would negatively impact parking stall requirements, fire access or site distance <br />vision requirements. <br />3. Where trash is picked up on an individual basis. <br />. Staff is also requesting that the enclosure areas be constructed with a concrete pad, as <br />opposed to asphalt. <br />. Staff is recommending approval without conditions. <br /> <br />Commission Questions of Staff: <br />None heard. <br /> <br />Applicant Presentation and Commission Questions of Applicant: <br />Mark Persichetti, chair of the LRCAB, reviewed the intent of the proposed ordinance and <br />clarified for the Commission that the ordinance was to be new construction of multi-family <br />residential and commercial and industrial developments. There is also a section that would <br />trigger the requirement when a major remodel of a project is requested. <br /> <br />Members of the Public: <br />None heard. <br /> <br />Commission Questions of Staff and Applicant: <br />Loo stated that the ordinance provides no incentives for a developer to provide the recycle area. <br /> <br />Persichetti stated that the ability to offer recycling for the tenant is the incentive. <br /> <br />Pritchard asked what if the tenant chooses not to recycle. <br /> <br />Persichetti stated that some will recycle and some will not. It has been noted by other <br />development that when recycle locations are offered that the amount of items recycled increases. <br /> <br />Wood requested a clarification prior to closing the public hearing that the ordinance is not just <br />for multi-family developments but included commercial and industrial developments. <br /> <br />Persichetti discussed that the intent ofLRCAB was to include multi-family residential, <br />commercial and industrial developments. <br /> <br />Wood requested that if the Commission is to approve the request then the motion for approval <br />should state that it includes multi-family residential, commercial and industrial developments. <br /> <br />Lipton inquired of staff if the Design Standards and Guidelines should be amended to reflect the <br />recycle requirement. <br /> <br />Wood stated the ordinance would create a new section to Chapter 17 of the Louisville Municipal <br />Code. The new section would then provide a means by which the Building Permit process would <br />trigger the requirement. This would also apply to the major remodel projects that do not trigger a <br />PUD amendment. <br />
