twenty-six lots are reflected on the General Development Plan as being 1 acre for <br />fourteen of the units, and 1.5 - 2.0 acre lots for the remaining twelve units. Based upon <br />the Intergovernmental Agreement density limitation of 1 dwelling unit per 4 acres, the <br />Bowes property is limited to 20 units. The density on the General Development Plan <br />reflects the transfer of an additional 7 units from the Admor West Parcel located adjacent <br />to and immediately to the east. The Intergovernmental Agreement designates the Admor <br />West Parcel as City Preservation Area and limits its future use to agriculture and low <br />density of no more than 1 dwelling unit per 5 acres, which results in approximately 6.7 <br />units. Mr. Bowes has submitted an offer to the City to purchase the respective <br />development rights for the Admor West Parcel. <br /> <br />Wood explained that the Resolution of Substantial Compliance represents the first <br />step in the annexation process. In this step, the Council must, by resolution, <br />determine whether the annexation petition and map, as submitted, substantially <br />comply with the statutory criteria for those documents. The resolution is not a <br />decision on the merits of the proposed annexation. The resolution sets a hearing on <br />the annexation request for December 7, 1999. Wood stated that the applicant is <br />available to answer any questions Council might have. <br /> <br />Davidson questioned whether Council should waive the applicant presentation until the <br />public hearing. <br /> <br />Council requested the opportunity to question the applicant. <br /> <br />Davidson called for applicant presentation. <br /> <br />Nancy Blackwood, Blackwood and Company, was in attendance to represent the property <br />owners. She explained that she understands this presentation is to determine whether the <br />annexation petition and map meet substantial compliance for an annexation. She <br />requested that Council provide some guidance on the proposed concept plan, in addition <br />to the request for a transfer of density from the Admor property. She explained that <br />clustering the homes on one portion of the site meets the Intergovernmental Agreement <br />criteria. She stated that Bill Simmons, City Administrator, has spoken to Jack Bowes over <br />the past several months regarding the purchase of the development rights from the Admor <br />property, which the Bowes family is very interested in. She stated that the proposal <br />allows for 60% of common open space on the Bowes property and the adjacent Admor <br />property. She explained that the homes are clustered in order to minimize the visual and <br />environmental impacts to each home site. She stated that the internal loop road is a <br />narrow country lane that meanders and loops through the site to provide access to the <br />homes. There is a park, including a pond, to provide recreational opportunities. She stated <br />that the proximity of the property to the Monarch Campus is an advantage to the <br />development concept. She asked for Council feedback and was available to answer any <br />questions, as was Chuck Keim, project engineer. <br /> <br />Davidson called for Council comments and questions. <br /> <br />4 <br /> <br /> <br />
