Davidson asked for the number of development rights that would be available for <br />purchase. <br /> <br />Wood replied that there would be 6.74 development units available for purchase, which <br />would result in a total of 26.20 development units. <br /> <br />Davidson stated that his calculations result in twenty-six development units and not <br />twenty-seven. <br /> <br />Wood agreed. <br /> <br />Davidson stated that Planned Community Zoned District-Residential zoning violates the <br />Comprehensive Development Plan for the area and the Intergovernmental Agreement. He <br />explained that the zoning would permit uses that are clearly not allowed and agreed with <br />Mayer that the zoning should be reevaluated. <br /> <br />Mayer stated that the proposed streets are substandard and questioned why the City <br />would accept substandard streets. <br /> <br />Davidson replied that the proposal does meet annexation requirements and questioned <br />why Council should continue discussing the details, which would be better suited during <br />the public hearing. <br /> <br />Light asked to clarify the acreage issue. He stated that on page two of the letter dated <br />October 12, 1999, it states: "The calculations as they now stand are 80.112 acres." He <br />questioned whether that area was the total area being proposed for annexation. <br /> <br />Blackwood replied, no and explained that the acreage reflects the total ownership. <br /> <br />Light asked if the ownership of 80.112 acres does not include the areas conveyed to the <br />City in fee title in 1996. <br /> <br />Blackwood replied that the acreage does not include that area. <br /> <br />Light asked for clarification that there is a claim being made for a fee title ownership of <br />Dillon Road right-of-way other than that conveyed in 1996. <br /> <br />Blackwood replied that her research indicates that the Dillon Road right-of-way as noted <br />on the annexation map is owned by the Bowes family. <br /> <br />Light stated that the Dillon Road right-of-way was originally a section line designation <br />by the County Commissioners and explained that there is some issue as to whether those <br />type of designations are a fee title designation or something different than that. <br /> <br /> <br />
