Preliminary PUD and Plat July 7, 2011 <br />th <br />96 and Dillon <br />portions of the landscape plan will be deferred until the development of the adjacent sites and <br />establishment of water taps for irrigation or domestic use purposes. <br />The public land dedication requirements for this parcel are 12% of the net land available for <br />development. As stated in the municipal code, each parcel will be required to dedicate 12% of <br />the remaining lands on each parcel after subtracting the dedication areas for public roads. As <br />contemplated in the zoning approval, the east and south trails will be in outlots dedicated to the <br />City and will count to that requirement provided they are not encumbered by services required to <br />support the development. <br />As agreed by the Owners, each will be required to meet the dedication requirement for their own <br />allocated parcel. When referring to allocated parcels, the Church parcel remains unchanged from <br />it’s original historic configuration, however the Games family and the Tennis Center have <br />negotiated the location of the public road to suit each of their needs and the dedications from <br />each will be based on the allocation of remaining parcels for each. The difference is subtle from <br />their historic land sizes and the total dedication for the project will meet the 12% of the net <br />parcel required. <br />public land dedication <br />For, there are three proposals with two differing methods. <br />The Church is offering to preserve the southwest corner of their property as a buffer to the <br />intersection as an Outlot dedicated to the City. This Outlot will preserve the rural character <br />of the other three corners of the intersection. The dedication will include the provision for <br />monument entry signage for the City in a portion of the Outlot and a higher level of <br />landscape in the immediate area of the sign and potential lighting of the sign. The combined <br />area of the Outlot for the area preservation, an Outlot for non-subdivision offsite drainage <br />described below and the trail Outlot meets the 12% dedication requirement. <br />The Tennis Center desires to complete its land dedication requirement by offering cash in <br />lieu for the balance of the dedication required after subtracting out the un-encumbered <br />portions of the trail Outlot. The development on this site is anticipated to occur soon after <br />the approvals of this preliminary PUD and the Tennis Center desires to lock up commitments <br />ahead of processing the associate site plans and final PUD with the City. <br />The Games family anticipates selling their parcel on the open market. The family is relying <br />on their own personal assets and the agreements with the Tennis Center to bring their land to <br />the table and facilitate the processing of the overall project at this time. The family desires <br />not to burden the land with a dedication of an Outlot and does not have the financial ability to <br />meet the cash in lieu requirement, but do understand the importance of this aspect of the <br />project and the needs of the City. As such, the Games family requests this requirement for <br />land dedication or cash in lieu be deferred until a development plan is presented to the City <br />for consideration.
