<br />17.42.040. Special Requirements for Co-location. Co-location can be an effective <br />way of minimizing the overall impact of CMRS facilities in the City. When done properly, <br />co-location of facilities can minimize the number of individual CMRS facilities and <br />concentrate them in one or several appropriate locations where view and aesthetic impacts are <br />minimal. As such, the City encourages co-location of multiple CMRS facilities. The <br />following are special requirements and design standards that apply to any CMRS facility site <br />designed to accommodate more than one user. <br /> <br />A. Any applicant proposing a CMRS facility which exceeds the maximum applicable <br />height requirements shall demonstrate the structural and technical capacity of the <br />structure and site to accommodate additional providers. <br /> <br />B. No owner or operator of any such structure shall act to unreasonably exclude other <br />CMRS Providers from co-locating on said structure. The owner or operator shall <br />negotiate in good faith to accommodate additional providers on their facility. In the <br />event an application is made for a new support structure, the applicant shall <br />demonstrate a good-faith effort has been made to co-locate, and if the City determines <br />such effort has not been made, the application may be denied. The City may intervene <br />in co-location negotiations when the City determines there is reasonable cause to <br />believe there has been abuse of the above requirements. In such circumstances, the <br />City may involve a third-party negotiator to resolve disputes. The cost of the third- <br />party negotiator shall be shared equally by the parties involved in the co-location <br />negotiation. <br /> <br />C. Height Requirements. <br /> <br />1. When an applicant can demonstrate that structural and technical capacity has <br />been provided for additional CMRS facilities, the maximum height of the <br />CMRS facility shall be increased a maximum of 20 feet for each potential <br />additional CMRS provider. <br /> <br />2. The height of any co-location structure shall not exceed 50 feet in <br />commercial zoning districts and 75 feet in industrial zoning districts. <br /> <br />D. Ground mounted mechanical unit&. <br /> <br />1. To ensure that the property can accommodate any ground mounted <br />mechanical units for future providers on the co-location site, potential <br />location(s) of future mechanical units enclosures shall be designated on the site <br />plan for the initial co-location CMRS facility proposal. Minor modifications to <br />those designated locations may be approved during the administrative review <br />process for future providers on the co-location site, provided that the <br />requirements of D.2, D.3, and D.4 are still met. <br /> <br />2. Said enclosures shall be grouped together to minimize the visual impact. <br /> <br />11 <br />
