<br />City Council <br />Meeting Minutes <br />January 2, 2007 <br />Page 9 of 10 <br /> <br />(Louisville Code of Ethics, Ordinance No. 1079, Series 1992 - Chapter 2.90 & <br />2.90.090 (C) - Authorized Topics) <br /> <br />City Attorney Light requested the City Council convene an executive session for <br />the purpose of consultation of pending litigation on the Hamon Contractors, Inc v. <br />the City of Louisville law suit, to discuss settlement options. He explained the <br />Colorado Revised Statues, the Louisville Home Rule Charter and the Louisville <br />Municipal Code provide the authority for convening an executive session to <br />discuss litigation matters. <br /> <br />City Clerk Varra recited Section 2.90.050 of the Louisville Municipal Code, which <br />governs the topics that may be discussed in an executive session. <br /> <br />MOTION: Mayor Sisk moved Council convene an executive session to discuss <br />pending litigation, as authoriz:ed by the Colorado Revised Statutes, the Home <br />Rule Charter and the Louisville Municipal Code, and requested Public Works <br />Director Phare and Interim Cilty Manager Balser be included in the executive <br />session. Mayor Pro Tern Brown seconded the motion. All in favor. <br /> <br />The regular meeting agenda items were suspended at 8:40 p.m. <br /> <br />REGULAR, BUSINESS ITEMS CONTINUED <br />REPORT BY CITY ATTORNEY FROM EXECUTIVE SESSION - <br />(Hamon Contractors, Inc., v. City of Louisville, et aI., Case No. 200SCV9820, <br />Boulder County District Court) <br /> <br />Mayor Sisk reconvened the rl3gular business meeting at 9:20 p.m. and asked <br />City Attorney Light to report Qin the executive session. <br /> <br />City Attorney Light reported in executive session, Council discussed settlement <br />strategies in the Hamon Contractors, Inc. v. City of Louisville law suit. He <br />thanked Council for their direction in the settlement strategy. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Light reported Qin another litigation memorandum, regarding the <br />lawsuit filed by Mr. Riggins. He requested Council authorization to issue letters <br />to the defendants. Council authorized the City Attorney to proceed. <br /> <br />Mayor Sisk reported on an ernail received from a resident relative to a mobile <br />home located at 744 West Street. He asked Planning Director Wood to address <br />the complaint. <br /> <br />Planning Director Wood explained the complainant, Mr. Davis, reports there is a <br />mobile home located 744 West Street, just east of his property.
