<br />SECTION 5. The following subsection (B) (3) is hereby added to <br /> <br />Title 17, Chapter 17. S6 I Section 17.56.170 of the Louisville Muni- <br /> <br />cipal Code: <br /> <br />B.3 . All new construction and substantial improvements <br />shall be constructed with materials and equipment <br />resistant to flood damage. <br /> <br />SECTION 6. Section 17.56. 180 (E) of the Louisville Municipal <br /> <br />Code is hereby repealed. <br /> <br />SECTION 7. The following subsection (E) is hereby added to Title <br /> <br />17 I Chapter 17.56 I SE~ction 17.56. 180 of the Louisville Municipal Code: <br /> <br />E. Restricted uses <br /> <br />1. Subsection A of Section 17.56.170 shall apply to this <br />district. <br /> <br />2. No encroachments I including fill, new construction, <br />substantial improvements or other developments <br />shall be permitted unless certification by a regis- <br />tered professional engineer stating that any encroach- <br />ment shall not result in an increase in flood levels <br />during the occurence of a hundred-year flood. <br /> <br />3. No mobile homes shall be placed in the floodway district. <br />SECTION 8. Section 17.56.210 of the Louisville Municipal Code <br /> <br />is hereby repealed. <br /> <br />SECTION 9. The following section is hereby added to Title 17, <br /> <br />Chapter 17.56 of the Louisville Municipal Code: <br /> <br />17.56.210 Building official to administer provisions - duties <br /> <br />The city building official shall: <br /> <br />A. AdministE~r the provisions of this chapter; and <br /> <br />B. Review all development permit applications to determine <br />whether a proposed building site will be reasonably <br />safe from flooding under the provisions of this chapter; and <br /> <br />C. Review all development permits to determine that all neces- <br />sary permits have been obtained from those federal, state or <br />local governmental agencies from which approval is required; and <br /> <br />D. Notify adjacent communities and the Colorado Water Conserva- <br />tion Board and Urban Drainage and Flood Control District prior <br />to any alteration or relocation of a watercourse, and submit <br />evidence of such notification to the Federal Insurance Admin- <br />istration. <br /> <br />E. Obtain, review, and reasonably utilize any base flood eleva- <br />tion data available from a Federal, State or other source, <br />until such other data has been provided by the Administrator I <br />as criteria for requiring that all new construction and substan- <br />tial improvements of residential structures have the lowest <br />floor (including basement) elevated to or above the base <br />flood levE~l and all new construction and substantial improve- <br />ments of nonresidential structures have the lowest floor <br />(including basement) elevated or floodproofed to or above <br />the base flood level. <br /> <br />-6- <br />
