Mr. Fisher stated that an ILC Survey was completed. Mr. Light suggested that with respect to the Planning Commissions condition number one, it would be in the City's interest for the survey to be provided prior to recordation of the PUD, and not prior to the issuance of the building permits. Mayer moved that Council approve Resolution No. 10, Series 2000, A Resolution Approving a Final PUD Development Plan for 706 Front Street and 700 Front Street (Site Improvements Only) Lots 5 and 6, Block B, Town of Louisville, including Planning Commission actions, deleting the phrase that "the City is unable to obtain the necessary access easement," to "the applicant is unable to obtain the necessary access easement," seconded by Howard. Sam Light, City Attorney proposed an amendment to Condition Number one, striking "building permit issuance." and inserting "recordation of the PUD." The amendment was accepted by Mayor and Howard. Sisk asked for clarification of the motion. If the railroad access could be gained, the applicant would utilize it. Mayer stated that if the applicant could gain the access easement, then Option 2 would be allowed. Sisk asked if the applicant cannot obtain the necessary access easement would Option 1 then be selected. Mayer stated that Option 1 would then be selected. Davidson moved to amend Condition 2., to change the comma after the word "implemented" and delete the rest of the sentence, seconded by Sisk. The amendment was accepted by Mayer. Roll call vote was taken on the second amendment. Motion failed by a vote of 4 to 2. Roll call vote on the original motion, as amended. Passed by a vote of 4 to 2.
