Mr. Fisher stated that an ILC Survey was completed. <br /> <br />Mr. Light suggested that with respect to the Planning Commissions condition number <br />one, it would be in the City's interest for the survey to be provided prior to recordation of <br />the PUD, and not prior to the issuance of the building permits. <br /> <br />Mayer moved that Council approve Resolution No. 10, Series 2000, A Resolution <br />Approving a Final PUD Development Plan for 706 Front Street and 700 Front Street (Site <br />Improvements Only) Lots 5 and 6, Block B, Town of Louisville, including Planning <br />Commission actions, deleting the phrase that "the City is unable to obtain the necessary <br />access easement," to "the applicant is unable to obtain the necessary access easement," <br />seconded by Howard. <br /> <br />Sam Light, City Attorney proposed an amendment to Condition Number one, striking <br />"building permit issuance." and inserting "recordation of the PUD." <br /> <br />The amendment was accepted by Mayor and Howard. <br /> <br />Sisk asked for clarification of the motion. If the railroad access could be gained, the <br />applicant would utilize it. <br /> <br />Mayer stated that if the applicant could gain the access easement, then Option 2 would be <br />allowed. <br /> <br />Sisk asked if the applicant cannot obtain the necessary access easement would Option 1 <br />then be selected. <br /> <br />Mayer stated that Option 1 would then be selected. <br /> <br />Davidson moved to amend Condition 2., to change the comma after the word <br />"implemented" and delete the rest of the sentence, seconded by Sisk. <br /> <br />The amendment was accepted by Mayer. <br /> <br />Roll call vote was taken on the second amendment. Motion failed by a vote of 4 to 2. <br /> <br />Roll call vote on the original motion, as amended.
