2. Variances may be issued for the reconstruction or restoration of structures listed on the National <br />Register of Historic Places or the state inventory of historic places without regard to the <br />procedures in the remainder of this section. <br />The requested variance is not related to the reconstruction or restoration of a structure on the <br />National Register of Historic Places. <br />Staff finds this criterion is not applicable. <br />3. Variances shall not be granted within any designated floodway if any increase in flood levels <br />during the base flood discharge would result. <br />The subject property is located in a floodplain, but it is not located within a designated floodway. <br />Staff finds this criterion has been met. <br />4. In addition to the general requirements in Section 17.48.110, a variance for a floodplain shall <br />only be granted upon a showing of good and sufficient cient cause when the board of adjustment finds <br />that the variance will not: <br />a. Result in increased flood heights; <br />The property is located in a still -water flood pond area and the vendor sheds will be wet- <br />floodproofed to allow water to move under there in a flood situation. Approval of the <br />variance will not result in increased flood heights. <br />b. Increase threats to public safety; <br />The vendor sheds will be anchored to the ground so they will not float away and increase <br />threats to public safety in a flood situation. <br />c. Create extraordinary public expense; <br />There is not any public expense associated with the construction of the vendor sheds, and <br />their construction will not require any publicly funded improvements. <br />d. Create a nuisance, cause fraud on, or victimize the public as identified in subsection B of <br />this section; or <br />e. Conflict with existing local laws or ordinances over which the board has no jurisdiction. <br />The wet-floodproofing design of the vendor sheds coupled with the fact they will be anchored to <br />the ground will ensure that any consequences from a flood event will not create a nuisance, cause <br />fraud on, or victimize the public. Staff did not identify any existing local laws or ordinances that <br />the vendor sheds would be in conflict with. <br />Staff finds that this criterion has been met. <br />5. Any applicant to whom a variance is granted shall be given proper notice that the structure shall <br />be permitted to be built with the lowest floor below the base flood elevation and that the cost of <br />6 <br />
