Paragraph A.3., second paragraph, "It is intended that there shall be no or very low <br />levels of passive recreation visitation," will remain as "intended," and "shall" <br />respectively. <br /> <br />9.) Page 7, Paragraph C. 2, "Open Space-Visitor land is intended be managed so that <br />recreational opportunities are designed to encourage resource protection with minimal <br />landscaping using native plants and limited irrigation," will be changed to "shall." <br /> <br />These changes were acceptable and agreed to by the Council and the petitioners. <br /> <br />Tom Phare, Pubic of Public Works, had questions relative to page 8; Section 4.03.030 <br />"Ability of City to Maintain Basic Infrastructure Not Impaired." He noted the paragraph <br />did not mention construction specifically, and there are some facilities under construction <br />utilizing pre-negotiated easements. He also noted there are potential drainage facilities, <br />that are not constructed, which will need maintenance. Also, the right-of-way access <br />along the 96th Street Open Space, is not specifically mentioned. <br /> <br />Brown stated that this concern was addressed on Page, 7, D., which grandfathered in any <br />existing obligation of the City. <br /> <br />Mayer stated that the provision specifically mentions uses and all uses contemplated in <br />any intergovernmental agreement. <br /> <br />Brown stated there would be respect of and flexibility towards plans based on pre- <br />existing criteria. When such plans do affect open space, those plans should be taken to <br />the board so members may have input and make recommendations to Council. <br /> <br />Davidson stated the intent of the Ordinance was is to have a public review process. <br /> <br />Brown stated that the Ordinance does not have the ability to preclude construction. The <br />Ordinance will allow for construction by review, however, there could be a revision to <br />include roadways to encourage safe and efficient operation of the City. <br /> <br />Mayer stated that he would accept that, but with the understanding that contemplated <br />construction such as building roads through open-space would not utilize open space <br />funds. <br /> <br />Davidson stated that open space funds can only be utilized for the purchase of open <br />space, and not for the construction of roadways. <br /> <br />Brown stated that the map and the fourth category were the only issues remaining to be <br />addressed. He stated that all lands are subject to the inventory and that the map has a <br />preliminary visual effect. He felt the issue most important was the fourth category. It <br />addresses whether or not lands that are potentially suitable for non-native plants, can be <br />separated out as the fourth category.
