<br />as required in this section. Backfill of any excavation made in any paved <br />street or alley right-of-way shall conform to the following conditions: <br />(1) Compaction. Backfill material shall be placed in lifts <br />not to exceed six (6) inches in depth by loose measurement, <br />moistened as required, and mechanically compacted to a minimum <br />of ninety-five (95) percent of the maximum density to be tested <br />and accepted by the ci ty engi neer. <br />(2) Material and gradation. <br />a. All excavated material shall be removed and backfill <br />shall be of select material meeting the specifications <br />established by the city engineer. <br />Sample of material to be used for backfill must be <br />sup~lied to the city engineering department forty-eight <br />(48) hours before backfill is to be made and such material <br />shall have received previous approval of the citye~gineer. <br />b. In streets and alleys paved with concrete or asphalt the <br />top twelve (12) inches of the backfill shall be made with <br />crushed gravel three-fourths (3/4) inches or less in diameter. <br />In gravel streets and alleys, the top eight (8) inches <br />of the backfill shall be made with crushed gravel three- <br />fourths inch or less in diameter. <br />c. These plans and specifications may be modified by the city <br />engineer so that they may be specifically adapted to the <br />particular conditions of travel, load requirements, terrain, <br />subsoil and moisture where the backfill is to be effected. <br />d. In the event of settlement or subsidence of a particular <br />elcavation or part thereof, the permittee who had performed <br />the excavation work shall be responsible for all repaving <br />and repair costs occasioned thereby. <br /> <br />Sec. 22 B-5. Replacement of paving and resurfacing by city. <br /> <br />Pavement and surfacing shall be replaced after an excavation in a street, <br />alley, or sidewalk by the city street department. <br /> <br />Sec. 22 B-6. Separation of surfacing material from soil required. <br /> <br />Excavators in paved or hard topped streets shall take care to separate <br />surfacing material from the soil removed from such excavation. <br /> <br />Sec. 22 B-7. Obstructing excavations prohibited. <br /> <br />It shall be unlawful to hinder or obstruct any paving operations or <br />excavations conducted in conformance with the provisions of this article. <br /> <br />Sec. 22 B-8. L i abi 1'i ty for damages. <br /> <br />Any person who shall undertake work pursuant to a permit issued under <br />the provisions of this article or to perform work under contracts with the <br />city or by virtue of permission obtained from the city council in accordance <br />with the provisions adopted by the city council, shall be answerable for any <br />damage occasioned to persons, animals or property by reason of carelessness <br />and negligence connected with such work. <br /> <br />Sec. 22 B-9. Duty to inform Director of Public Works of pipes and <br />Other structures. <br /> <br />It shall be the duty of every person to furnish on request to the city <br />engineer information regarding the location in any street, alley, sidewalk <br />or other public place of the city of any pipe or other structure installed, <br />maintained or utilized by such person. <br /> <br />-2- <br />
