ARTICLE 5 VARIANCES Section 5-101. Unusual Conditions The City Council, upon advice of the Planning Commission, may authorize var- iances from these regulations in cases where, due to exceptional topographical conditions or other conditions peculiar to the site, an unnecessary hardship is placed on the subdivider. Such variances shal I not be granted if it would be detrimental to the publ ic good or impair the intent and purposes of this Ordinance. The variance shat I be in keeping with the intent of the compre- hensive development plan for the City. Section 5-102. Planned Unit Development Variances to the requirements of this Ordinance may be authorized by the City Counci I upon advice of the Planning Commission in the case of a planned unit development. The review and approval procedure for a planned unit devel- opment shall be the same as for a subdivision. Additionally, the planned unit development is subject to the fol lowing provisions: (A) Special requirements. (I) The tract or parcel of land involved shal I be either in one owner- ship or the subject of an application fi led jointly by the owners of at I the property to be included. (2) Areas and faci I ities of joint use shal I be retained in title by the subdividers, or deeded to a legally recognized organization composed of al I home owners in the development or when acceptable, deeded to the City. Said areas and facil ities shal I be perpetually maintained and the plan which the subdivider presents to ensure the intent hereof is carried out shal I be subject to the approval of the City Attorney. (S) Information required. (I) AI I information required for Preliminary and Final Plats as speci- fied in this Ordinance; (2) AI I information required for a final development plan as specified in Section 6-113 of the Zoning Ordinance of the City of Louisvi I Ie. 5-1
