<br />ARTICLE 5 <br /> <br />VARIANCES <br /> <br />Section 5-101. Unusual Conditions <br /> <br />The City Council, upon advice of the Planning Commission, may authorize var- <br />iances from these regulations in cases where, due to exceptional topographical <br />conditions or other conditions peculiar to the site, an unnecessary hardship <br />is placed on the subdivider. Such variances shal I not be granted if it would <br />be detrimental to the publ ic good or impair the intent and purposes of this <br />Ordinance. The variance shat I be in keeping with the intent of the compre- <br />hensive development plan for the City. <br /> <br />Section 5-102. Planned Unit Development <br /> <br />Variances to the requirements of this Ordinance may be authorized by the <br />City Counci I upon advice of the Planning Commission in the case of a planned <br />unit development. The review and approval procedure for a planned unit devel- <br />opment shall be the same as for a subdivision. Additionally, the planned unit <br />development is subject to the fol lowing provisions: <br /> <br />(A) Special requirements. <br /> <br />(I) The tract or parcel of land involved shal I be either in one owner- <br />ship or the subject of an application fi led jointly by the owners <br />of at I the property to be included. <br />(2) Areas and faci I ities of joint use shal I be retained in title by <br />the subdividers, or deeded to a legally recognized organization <br />composed of al I home owners in the development or when acceptable, <br />deeded to the City. Said areas and facil ities shal I be perpetually <br />maintained and the plan which the subdivider presents to ensure the <br />intent hereof is carried out shal I be subject to the approval of <br />the City Attorney. <br /> <br />(S) Information required. <br /> <br />(I) AI I information required for Preliminary and Final Plats as speci- <br />fied in this Ordinance; <br />(2) AI I information required for a final development plan as specified <br />in Section 6-113 of the Zoning Ordinance of the City of Louisvi I Ie. <br /> <br />5-1 <br />
