The subject property is zoned Commercial
Business (CB), which allows for a full range of office and retail uses.

Wood stated that in the Final Subdivision Plat, the open space dedication is .25 acres in
Tract A, which meets the 12% requirement. He noted that the PUD final development
plan proposes a two-phase commercial office/retail development. Phase I, if authorized,
would develop a 13,000 SF, two story office building on the westerly 1.09 acre portion of
the site. Part of that 13,000 SF (2,500) would be designated as rental offices. The balance
of the site, or easterly .77 acres, would be proposed for a second freestanding
retail/restaurant or office building. Phase II would be subject to a separate PUD review.

Wood stated that access for the development would depend on a right/in - right/out
constructed on SH42 and the utilization of private access easements. Those easements
are located immediately to the south in the Coal Train Square Subdivision and the
Christopher Village Subdivision as access to South Boulder Road.

5
