Louisville City Council Meeting <br />April 4, 2000 <br />Page 5. <br /> <br />ORDINANCE NO. 1334, SERIES 2000 - AN ORDINANCE APPROVING A <br />VACATION OF AN EMERGENCY ACCESS EASEMENT DEDICATED TO <br />THE CITY OF LOUISVILLE ON LOTS 1 AND 2, BLOCK 2, THE PARK AT <br />CTC - 2nd reading - public hearing (advertised Daily Camera 3/ /00) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />Sam Light, City Attorney read Ordinance No. 1334 Series 2000 -An Ordinance <br />Approving a Vacation of an Emergency Access Easement Dedicated to the City of <br />Louisville on Lots 1 and 2, Block 2, The park at CTC. <br /> <br />Davidson called for Staff presentation. <br /> <br />Paul Wood, Planning Director stated that the applicant is requesting to vacate an <br />emergency easement currently on Lots 1 and 2 of Block 2 at the park at CTC. The <br />subdivision plat was approved by City Council on March 31, 1998. Wood stated that <br />through the subdivision and PUD review process, the applicant proposed a public <br />improvement phasing plan and that in order to meet the fire code secondary emergency <br />access requirements, a temporary emergency access easement was required across Lots 1 <br />and 2 of Block 2. The applicant subsequently chose to complete all public <br />improvements, including streets, in one phase and therefore, the proposed secondary <br />emergency access is no longer required. The two affected property owners have <br />requested vacation and staff has no objections. <br /> <br />Davidson opened the public hearing and asked if there was anyone in the audience who <br />wished to speak in favor or opposition to Ordinance No. 1334. Hearing none, Davidson <br />closed the public hearing. <br /> <br />There was discussion about the vacation of the easement providing any additional <br />building spaces or expansion on either property. Wood stated that it would not create <br />additional building space, however, it will remove those encumbrances from those <br />plotted lots and that if there were an approved building, it would require a PUD <br />amendment. <br /> <br />MOTION: Sisk moved that Council approve Ordinance No. 1334, Series 2000 - An <br />Ordinance Approving a Vacation of an Emergency Access Easement Dedicated to the <br />City of Louisville on lots 1 and 2, Block 2, the Park at CTC, on second and final reading, <br />seconded by Howard. Roll Call Vote was taken. Motion passed by a vote of 7-0. <br /> <br /> <br />
