PAGE SEVEN
SUBJECT: ORDINANCE NO. , SERIES 2011 — AN ORDINANCE AMENDING
CHAPTER 15.36 OF THE LOUISVILLE MUNICIPAL CODE REGARDING
THE PROCEDURES APPLICABLE TO DEMOLITION REVIEW OF
BUILDINGS THAT ARE OVER FIFTY YEARS OLD
DATE: DECEMBER 6, 2011
All of the land use applications described in the LMC have similar submittal requirements. By
providing a conceptual drawing staff and the HPC may review how the applicant intends on
modifying the historic structure so it is easier to determine how the modifications may
potentially impact the architectural integrity of the historical structure.
FISCAL IMPACT:
Amending LMC Section 15.36.200 as proposed would not impose a fiscal impact on the City
of Louisville and may result in minor savings to the City and applicants by clarifying
administrative procedures.
RECOMMENDATION:
Approve Ordinance No. Series 2011, amendments to Section 15.36.200 of the
Louisville Municipal Code (LMC), with the following condition (if Council agrees with staffs
concern related to the demolition permit going with the applicant rather than the property):
1. Modify Section 15.36.200.M to state "Further, if the building permit requested
within such one -year period is not consistent with the property owner's written
explanation and /or drawings of the plan for the building, or the building is no
longer owned by thc building demolition permit applicant or thc heirs of thc
applicant, a new demolition review shall be required.
ATTACHMENT(S):
1. Proposed code amendment — Draft Ordinance of Section 15.36.200 from City
Attorney
2. Letter from Historic Preservation Commission, dated September 19, 2011
3. Demolition Process Flowchart
