<br />Louisville City Council Meeting <br />January 4,2005 <br />Page 3 of8 <br /> <br />Mayor Sisk thanked the American Legion Post 111 for the Colorado flag and pole, and <br />for their many contributions to the citizens of Louisville. <br /> <br />RESOLUTION No.1, SERIES 2005 - A RESOLUTION APPROVING THE <br />BOULDER VIEW SUBDIVISION REPLAT AND FINAL PUD DEVELOPMENT <br />PLAN <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Paul Wood reviewed the history of the Waldman request for <br />authorization for a subdivision replat and final PUD development plan for Lot 1 Boulder <br />View Subdivision. The request follows authorization by City Council to amend the <br />underlying Faber Annexation. The applicants are applying for a subdivision replat of Lot <br />1 to create an additional lot for the purpose of building a new residence. The proposed <br />new lots are referred to as replat Lot 1 and replat Lot 2. The RR zoning provides for a <br />minimum lot area of20,000 square feet. <br /> <br />The amended annexation agreement provides for the property owner to convey to the <br />City of Louisville a conservation easement over the westernmost 1.5 acres. In <br />conjunction with the subdivision replat of Lot 1, the owner would grant to the City of <br />Louisville a perpetual and irrevocable deed of conservation easement over the <br />westernmost 1.5 acres. No uses would be allowed on the conservation easement other <br />than crop production or growing of landscape materials. The Owner shall convey the <br />conservation easement to the City at or prior to the recording of any plat or plan allowing <br />the development of a second residential unit on the Waldman Property. The Owner <br />specifically agrees that such easement shall be a prerequisite to the recording of any such <br />plat or plan. <br /> <br />Wood reviewed the Planning Commission action of support of the replat and the request <br />of zoning relief from the RR Zone District through the PUD subject to three conditions. <br />He noted the Planning Commission record reflects that Commissioner Kalish did not <br />support the motion. <br /> <br />Mayor Sisk requested an Applicant presentation. <br /> <br />David Waldman, 255 Continental View Drive, Louisville, CO reported the proposal <br />submitted to the Planning Commission and the City Council is the same proposal that <br />was submitted in March of 2004. <br /> <br />COUNCIL COMMENT <br /> <br />Mayor Sisk asked for the basis of Commissioner Kalish voting no on the replat. Wood <br />stated Commissioner Kalish expressed her belief that the PUD should not be a vehicle to <br />address zoning relief for the replat request. It was her opinion that an application should <br />have been filed with the Board of Adjustments. <br /> <br />3 <br />
