This plan is only available to local and state government employees and <br />is based on a private letter ruling from the IRS to ICMA-RC. <br /> <br />The amount of money being deferred by the employees is not subject to payment of <br />FICA or unemployment taxes either by the employee or the City. The savings will offset <br />the administrative fees participating in the plan, and their levels of participation. <br />Employees will also be charged an administrative fee, to be deducted from their accounts. <br />Adoption of the resolution and implementation of the plan will enable the City to offer <br />the program to employees. The City's employees will be allowed up to 60 days to <br />determine whether or not they wish to participate in the program. Thereafter, there will <br />be an annual open enrollment period when employees may elect to join the program. <br />The City Attorney and benefits counsel have reviewed the documents provided by <br />ICMA-RC for the adoption and implementation of the plan, and have no changes. <br /> <br />COUNCIL COMMENT <br /> <br />Mayor Sisk asked Finance Director Patty Leslie if there would be any negative impact to <br />the City in adopting this resolution. Finance Director Leslie responded no. <br /> <br />MOTION: Council member Keany moved for Council approval of Resolution No.9, <br />Series 2005, seconded by Council member VanPelt. Roll call vote was taken. The <br />motion passed by a vote of7-0. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Sam Light reported on a court matter; the Capitol Press vs. the City of <br />Louisville and Custodian of the Records Nancy Varra. He reviewed the City's petition <br />and noted the Court has asked if the City wishes to voluntarily withdraw the petition or <br />file a default judgment. He noted if the petition is withdrawn the District Court will not <br />enter a ruling on the petition. He requested Council guidance. <br /> <br />Council member Keany felt the City should proceed with the filing of a default judgment. <br />There was Council Consensus. <br /> <br />CITY MANAGER'S REPORT <br /> <br />Assistant City Manager for Governmental Relations Heather Balser updated City Council <br />on the progress of the Cable Franchise Renewal process. She reported a random survey <br />was sent out to Louisville residents relative to ComCast services. The result will be <br />tabulated and reported to the City Council in April. <br /> <br />Public Works Director Tom Phare updated Council on the US Highway 42/96th Street <br />connection and projected its completion by the middle of April. He explained as weather <br />permits, bridges, concrete, and asphalt work will all be completed. <br /> <br />8 <br />
