Louisville City Council Meeting <br />May 16, 2000 <br />Page 9. <br /> <br />MOTION: Davidson moved that Council continue Resolution No. 22, Series 2000, A <br />Resolution Approving an Amendment Final PUD Development Plan and Minor <br />Subdivision Replat at the Bella Vista South Subdivision to the June 20, 2000 meeting, <br />seconded by Howard. All in favor. <br /> <br />RESOLUTION NO. 23, SERIES 2000 - FINAL PUD DEVELOPMENT PLAN <br />(AKA TECH CENTER COMMONS) AND MINOR SUBDIVISION REPLAT <br />(REPLAT A) FOR LOTS 6A, 10A, AND 10B, BLOCK, CTC, FIRST FILING <br />(continued from 4/4/00) <br /> <br />Davidson called for Staff presentation. <br /> <br />Sam Light, City Attorney made preliminary comments prior to the Staff presentation of <br />the Final PUD and Replat. Light noted that this plan includes a Final PUD and Final <br />Subdivision Agreement on the Tech Center Commons. <br /> <br />Howard asked for a legal opinion as to whether he would have a conflict of interest with <br />this Final PUD Development Plan. <br /> <br />Light clarified that it was his understanding that there is not a Special Review Use <br />pending for the properties. Therefore, as a Board Member of the Peak to Peak Charter <br />School, with no pending action for the Peak to Peak Board, in which they have an interest <br />there would be no issue under the Ethics Ordinance <br /> <br />Light reviewed the background of the application, which includes a Final PUD and <br />Replat. Light noted that the project was continued from April 4, 2000 to July 18, 2000 or <br />to an earlier date upon proper notice. After the April 4, 2000 meeting there was a request <br />for a Special Review Use for a school submitted by the O'Connor Group and Peak to <br />Peak Charter School. A letter submitted to the City, dated April 26, 2000 withdrew the <br />request. With the withdrawal of the Special Review Use, Staff published a notice <br />allowing the Final PUD and Minor Subdivision Replat to come back before Council. <br />Light noted that it is Staff's understanding that the property owner and the school have <br />specifically withdrawn their request for a Special Review Use for a school. Light stated <br />that with the withdrawal, Council could review the application for Final PUD and Replat <br />without any Special Review Request. <br /> <br />Ken Johnstone, Principal Planner Director stated that the application remains the same, <br />no changes have been made. Johnstone reviewed that the application is for a replat of <br />two existing lots into three lots, combined with a Final PUD Development Plan to <br />construct three speculative, light industrial buildings.
