<br />City Council <br />Meeting Minutes <br />May 17, 2005 <br />Page 10 of 12 <br /> <br />Mr. Luallin explained CCTV is an all volunteer group that fills the needs for <br />Louisville, Lafayette, Erie and Superior. He requested Council consideration for <br />funding 10-12% of the CCTV budget. <br /> <br />Cecilia Girz, 4669 Ingram Court, Boulder, CO stated the Needs Assessment <br />report omitted the service CCTV provides for nonprofits. She thanked Council for <br />their support. <br /> <br />COUNCIL COMMENTS <br /> <br />Council member Brown asked Mr. Fellman to comment on the potential closure <br />of the public access television facility. Mr. Fellman stated the last franchise <br />agreement required the provision of a facility however new federal legislation <br />eliminated that provision. It was his understanding ComCast has no intention of <br />providing a facility once there is a new franchise agreement. <br /> <br />Council member Brown suggested the City Council move forward with the <br />negotiations with ComCast for a new franchise agreement. <br /> <br />Council member Keany addressed the CCTV letter and the Needs Assessment <br />Report. He stated his understanding that the rates could not be regulated, but <br />asked if a limited tier of services could be provided for in the agreement. <br /> <br />Mayor Sisk commented on the report and stated the City can now go forward <br />with the negotiation process with ComCast. He suggested the Needs <br />Assessment be approved and Council conduct a future executive session to <br />discuss negotiations. He stated Louisville will meet with other communities <br />relative to public access television. <br /> <br />Mr. Fellman asked Council to consider what they want to have in their cable <br />television franchise agreement. He explained the US Cable Acts does not <br />regulate cable television rate, but voiced his belief the provision of limited basic <br />tier rates may be applicable. He noted Comcast may argue against a limited tier <br />of service. <br /> <br />Council member Keany requested that Mr. Feldman prepare a confidential memo <br />to the Council that would assist them in identifying what should be requested in a <br />franchise agreement. <br /> <br />MOTION: Council member Brown moved for Council adoption of the Findings <br />from the Needs Assessment Report for the City of Louisville, CO Cable <br />Television Franchise Renewal. Council member Keany seconded the motion. <br />All in favor. <br />
