Staff has <br />requested a continuance of the ordinance to the June 7, 2005 meeting. <br /> <br />MOTION: Mayor Sisk moved that Council continue Ordinance No. 1470, Series <br />2005, to June 7, 2005, seconded by Council member Keany. All in favor. <br /> <br />ADOPT FINDINGS FROM NEEDS ASSESSMENT REPORT FOR CITY OF <br />lOUISVillE, COLORADO CABLE TELEVISION FRANCHISE RENEWAl- <br />public hearing <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Assistant City Manager for Governmental Relations Heather Balser reported the <br />Needs Assessment Report for the Cable Television Franchise Renewal was <br />reviewed by Council at the April 26, 2005 study session. Minor modifications <br />were made to the report. Council requested the Staff present the report in a <br />public hearing format at the May 17, 2005 meeting, for final consideration and <br />adoption by the City Council. Copies of the report are available on the City's <br />Web site, at the Library and in the City Clerk's office. Additionally, a CCTV letter <br />dated March 16, 2005, was entered into the report at their request. She <br />introduced Mr. Ken Fellman, Kissinger & Fellman, consultant who prepared the <br />Needs Assessment Report. Mr. Fellman would give a brief presentation and <br />summary. <br /> <br />Ken Fellman, Kissinger & Fellman, P.C., 3773 Cherry Creek N. Drive, Ptarmigan <br />Place, Suite 900, Denver, CO, presented a brief overview of the Needs <br />Assessment Report. He explained negotiating a cable franchise is acting within <br />a limited scope of authority. A cable company is entitled to a franchise renewal <br />that meets the needs of the community and offers financial, technical, and legal <br />ability to do so. <br /> <br />He reviewed the needs assessment process; the results of the public process; <br />the mail survey; the on-line survey; focus group; public meetings; the technical <br />evaluation; and legal compliance evaluation. At the public meetings, issues were <br />identified as existing and forwarding issues that need to be addressed in the <br />franchise. He explained that some issues may be fruitless to pursue because the <br />federal law has changed since the last franchise was adopted. He stated a <br />number of the compliance problems stem from language that was less clear in <br />the existing franchise. He stated the FCC insures the City exercise its right for <br />consumer protection, to make it clear that all City codes are documented. <br /> <br />He addressed government access, public access, and educational access; and <br />the quality of the equipment to broadcast programs.
