Louisville City Council Meeting <br />June 20, 2000 <br />Page 10. <br /> <br />adjacent to the Warembourg farm. That clarified the limits of any road extension to the <br />south. He noted that was concluded approximately one year ago. <br /> <br />Howard asked Phare if the applicant came forward with a proposal to the City. Phare <br />stated that applicant may have requested less dedication because of the unexpected <br />impact to the lot. <br /> <br />Howard clarified that the City did not request a delay, that the applicant was evaluating <br />the impact to the lot and this transpired one-year ago. He asked if that was related back <br />to the applicant. Phare stated that there might have been some discussion back and forth. <br /> <br />Howard asked Phare if there were improvements to the land one-year ago. Phare stated <br />that improvements have been on the ground for at least two years, if not more. <br /> <br />Brown stated his understanding that the major point is that the applicant could have <br />moved forward with the five lot proposal, and with the original size of the outlot, but <br />more recently decided they had opportunity to move forward with six lots. <br /> <br />Geil argued that there was no mention of the fact they could not go back to the same 5' <br />setback that they maintained for Lot 3 on the original five lot PUD. He stated that there <br />was no mention of a 25' setback along the road. When they proceeded with development <br />of lots, it was discovered that the original PUD was never recorded. <br /> <br />Brown stated' that it is a very confusing situation and that it appears there are two <br />different understandings. Based on these misunderstandings he would move forward with <br />the compromise he proposed earlier. <br /> <br />Roll call vote on the amendment was taken. Motion failed by a vote of 2-4. Davidson, <br />Sisk, Mayer and Howard voted no. <br /> <br />Roll call vote on the motion was taken. Motion passed by a vote of 4-2. Keany and <br />Davidson voted no. <br /> <br /> RESOLUTION NO. 34, SERIES 2000 - RESOLUTION APPROVING AN <br />AMENDED FINAL PUD DEVELOPMENT PLAN AND SPECIAL REVIEW USE <br />FOR PEAK TO PEAK CHARTER SCHOOL, LOTS 1 & 2, BLOCK 5, CTC, 1812 <br /> BOXELDER STREET <br /> <br />Davidson stated that the President of the Board of the Peak to Peak Charter School has <br />requested this matter be continued. Davidson moved that Council continue Resolution <br /> <br />10 <br /> <br /> <br />
