Louisville City Council Meeting June 20, 2000 Page 4. Davidson referred to the Ordinance, page 2, paragraph 3, which states that protests would be heard by the City Council. He felt this to be an administrative rather than legislative action. He suggested that protests be brought before the City Administrator. Several members of Council concurred. MOTION: Sisk moved that Council adopt Ordinance No. 1338, Series 2000, with an amendment to Section 9.40.040, C, that in the event of protest, the City Administrator will make the final decision, and D, that the City Administrator may approve the application with conditions, seconded by Brown. Mayer offered a friendly amendment to Section C, in the final clause, the City Administrator be substituted for the City Council. City Attorney Light, stated his concern that the concept of a public hearing before the City Council is replaced by final determination by the City Administrator. He offered an amendment that in a case of rejection, the application shall be referred to the City Administrator for a final determination, based on the application, the written objections presented to the City Clerk, and other materials that may be provided to the City Administrator by either the applicant or the objector. Howard offered a friendly amendment to authorize the Mayor to accept the City Attorney' s changes. Sisk and Brown accepted the amendment. Roll call was taken. The motion passsed by a vote of 6-0.
