Louisville City Council Meeting <br />June 20, 2000 <br />Page 4. <br /> <br />Davidson referred to the Ordinance, page 2, paragraph 3, which states that protests would <br />be heard by the City Council. He felt this to be an administrative rather than legislative <br />action. He suggested that protests be brought before the City Administrator. Several <br />members of Council concurred. <br /> <br />MOTION: Sisk moved that Council adopt Ordinance No. 1338, Series 2000, with an <br />amendment to Section 9.40.040, C, that in the event of protest, the City Administrator <br />will make the final decision, and D, that the City Administrator may approve the <br />application with conditions, seconded by Brown. <br /> <br />Mayer offered a friendly amendment to Section C, in the final clause, the City <br />Administrator be substituted for the City Council. <br /> <br />City Attorney Light, stated his concern that the concept of a public hearing before the <br />City Council is replaced by final determination by the City Administrator. He offered an <br />amendment that in a case of rejection, the application shall be referred to the City <br />Administrator for a final determination, based on the application, the written objections <br />presented to the City Clerk, and other materials that may be provided to the City <br />Administrator by either the applicant or the objector. <br /> <br />Howard offered a friendly amendment to authorize the Mayor to accept the City <br />Attorney' s changes. <br /> <br />Sisk and Brown accepted the amendment. <br /> <br />Roll call was taken. The motion passsed by a vote of 6-0. <br /> <br />ORDINANCE NO. 1339, SERIES 2000 - AN ORDINANCE DELEGATING TO <br />THE CITY ADMINISTRATOR THE AUTHORITY TO ESTABLISH CITY <br />WATER TAP FEES ON A QUARTERLY BASIS AND AMENDING CERTAIN <br />SECTIONS OF CHAPTER 13.12 OF THE LOUISVILLE MUNICIPAL CODE IN <br />CONNECTION THEREWITH - 2nd reading - public hearing (advertised Daily, <br />Camera 5/20/00) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />Sam Light, City Attorney read Ordinance No. 1339, Series 2000. <br /> <br />Davidson called for Staff presentation. <br /> <br /> <br />
