City Council
Meeting Minutes
September 6, 2005

Mr. Gordon Fordyce thanked Council for their consideration.

COUNCIL COMMENT

Council member Keany asked for clarification of the proposed expansion.
Principal Planner Johnstone explained the expansion is not for auto body work.

Council member Keany requested a more detailed description of what could be
housed within the expanded area. He requested a note on the PUD that no
wrecked vehicle could be housed in the expanded area.

City Attorney Light asked for direction on the notes on the PUD. He explained
the Development Agreement would include conditions and the Subdivision
Agreement could also be revised to include conditions.

Mr. Fordyce requested notification of any violation on his property.

Council member Marsella voiced concern the expansion may not be compatible
with the Highway 42 Revitalization project. Principal Planner Johnstone
explained there are entitlements on the existing PUD, and the City must balance
what the plan recommends and what has been previously approved.

Council member Keany stated there may be advantages for an auto body shop in
close proximity to transit oriented businesses.

Mayor Sisk stated the City may gain some benefit from the Fordyce proposal and
voiced his support of the resolution.

MOTION: Council member Keany moved for Council approval of Resolution No.
35, Series 2005, seconded by Council member Clabots. All in favor. Absent:
Council member Levihn.

RESOLUTION NO. 36, SERIES 2005 - A RESOLUTION APPROVING A
PURCHASE CONTRACT TO BUY AND SELL REAL ESTATE FOR
ACQUISITION OF A PORTION OF THE WAREMBOURG PARCEL 2
PROPERTY, FOR CONSTRUCTION OF THE COAL CREEK REGIONAL
TRAIL AND OTHER GOVERNMENTAL PURPOSES, AND APPROVING AN
AMENDMENT TO THE CITY-COUNTY CONSERVATION EASEMENT OVER
THE WAREMBOURG PARCEL 2 PROPERTY

Mayor Sisk requested a Staff presentation.

Parks Project Manager Kathy Kron reported the new section of the Coal Creek
Regional Trail south of Bella Vista Drive is nearing completion.
