<br />City Council <br />Meeting Minutes <br />September 20, 2005 <br />Page 6 of 15 <br /> <br />Rick Brew, 457 Pearl Street, Boulder, CO, stated he has an annexation <br />agreement with City of Louisville, which dates back to 1989. His property is <br />shown in the 1989 North Louisville PCZD General Development Plan. He will not <br />be ready to submit their proposal to the Planning Department for a year and has <br />concerns over the low numbers of permits and the permit allocation process. He <br />expressed fear he could be squeezed out of the permit process and requested <br />more flexibility on the permit cap. <br /> <br />COUNCIL COMMENT <br /> <br />Council member Van Pelt asked Mr. Brew why he hasn't developed his property <br />in the last fifteen years. Mr. Brew explained he acquired the property last year. <br />The land position has been confused for some time and he is currently in the <br />process of resolving those issues. <br /> <br />Council member Brown asked for clarification on repealing Resolution No. 36, <br />Series 1993. Planning Director Wood stated the request is based on the main <br />focus being on Resolution No. 38, Series 2005, the phasing of residential units. <br /> <br />Mayor Sisk voiced his support for Resolution No. 38, Series 2005. He stressed <br />the Comprehensive Plan is not proposed to give priority to one development over <br />another. He welcomed Mr. Brew's development proposal for the Council review. <br />On repealing No. 36, Series 1993, he suggested the City Attorney analyze <br />whether Resolution Nos. 36 and 18 are necessary. <br /> <br />MOTION: Council member Marsella moved for approval of Resolution No. 38, <br />Series 2005, seconded by Council member Brown. <br /> <br />City Attorney Light offered a friendly amendment correcting the resolution on <br />page 3, Section 2: Biennial Allocations and be reviewed biennially. Council <br />members Marsella and Brown accepted the amendment. <br /> <br />VOTE: Roll call vote was taken. The motion carried by a vote of 7-0. <br /> <br />ORDINANCE No. 1477, SERIES 2005 - AN ORDINANCE APPROVING AN <br />ANNEXATION, KNOWN AS THE CITY OF LOUISVILLE S. 96TH STREET <br />ANNEXATION No.3, TO THE CITY OF LOUISVILLE, COLORADO - public <br />hearing - 2nd reading (advertised Daily Camera 9/10/05) <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1477, Series 2005, Ordinance No. 1478, <br />Series 2005, and Resolution No. 39, Series 2005, all relating to the S. 96 Street <br />Annexation, Zoning, and Annexation Eligibility. <br />
