City Council Meeting Minutes September 20, 2005 Page 6 of 15 Rick Brew, 457 Pearl Street, Boulder, CO, stated he has an annexation agreement with City of Louisville, which dates back to 1989. His property is shown in the 1989 North Louisville PCZD General Development Plan. He will not be ready to submit their proposal to the Planning Department for a year and has concerns over the low numbers of permits and the permit allocation process. He expressed fear he could be squeezed out of the permit process and requested more flexibility on the permit cap. COUNCIL COMMENT Council member Van Pelt asked Mr. Brew why he hasn't developed his property in the last fifteen years. Mr. Brew explained he acquired the property last year. The land position has been confused for some time and he is currently in the process of resolving those issues. Council member Brown asked for clarification on repealing Resolution No. 36, Series 1993. Planning Director Wood stated the request is based on the main focus being on Resolution No. 38, Series 2005, the phasing of residential units. Mayor Sisk voiced his support for Resolution No. 38, Series 2005. He stressed the Comprehensive Plan is not proposed to give priority to one development over another. He welcomed Mr. Brew's development proposal for the Council review. On repealing No. 36, Series 1993, he suggested the City Attorney analyze whether Resolution Nos. 36 and 18 are necessary. MOTION: Council member Marsella moved for approval of Resolution No. 38, Series 2005, seconded by Council member Brown. City Attorney Light offered a friendly amendment correcting the resolution on page 3, Section 2: Biennial Allocations and be reviewed biennially. Council members Marsella and Brown accepted the amendment. VOTE: Roll call vote was taken. The motion carried by a vote of 7-0. City Attorney Light read Ordinance No. 1477, Series 2005, Ordinance No. 1478, Series 2005, and Resolution No. 39, Series 2005, all relating to the S. 96 Street Annexation, Zoning, and Annexation Eligibility.
