City Council <br /> Meeting Minutes <br /> January 3, 2011 <br /> Page 3 of 14 <br /> addition, the City Council may employ other special counsel such as a Water Attorney. <br /> All appointees serve at the pleasure of the City Council except for Municipal Judges <br /> who are appointed for a two-year term pursuant to Section 9-3 of the Charter. <br /> MOTION: Mayor Muckle moved to appoint the following officials: City Attorney— Light, <br /> Harrington & Dawes, P.C., and Water Attorney—Yates Law Firm. Municipal Judge-W. <br /> Bruce Joss, Deputy Municipal Judge - Jeffrey Cahn and City Prosecuting Attorney- <br /> Colette Cribari. The motion was seconded by Councilor Keany. All were in favor. <br /> City Clerk Varra swore in Municipal Judge W. Bruce Joss. Judge Joss then swore in <br /> City Attorney Samuel Light, Water Attorney Alan Hill, Deputy Municipal Judge Jeffrey <br /> Cahn and City Prosecutor Colette Cribari. <br /> City Attorney Light thanked the Council for the honor of serving the City and noted he <br /> feels fortunate to also live in the City of Louisville. Water Attorney Hill thanked Council <br /> for his appointment as Water Attorney for the last eight years. He voiced his <br /> appreciation for the confidence Council has shown in him. Prosecuting Attorney Cribari <br /> also thanked the Council for her appointment. <br /> RESOLUTION No. 1, SERIES 2012—A RESOLUTION APPROVING A BUSINESS <br /> ASSSISTANCE AGREEMENT WITH 100-MILE MERCANTILE, INC. FOR <br /> REINVESTMENT AND ATTRACTION OF A NEW RETAIL OUTLET AT 1817 <br /> HIGHWAY 42 IN THE CITY OF LOUISVILLE <br /> Mayor Muckle requested a staff presentation. <br /> City Manager Fleming explained the proposal is for an Economic Development <br /> Business Assistance Package (BAP)for 100-Mile Mercantile. The applicant, Tony <br /> Renfrow intends to establish a retail store in approximately 1,900 square feet located at <br /> 1817 Highway 42 in Louisville. 100-Mile Mercantile, Inc. will offer food, clothing, toys, <br /> kitchen items, furniture, and textiles. All products carried in the store will be sourced <br /> from local suppliers. The terms of the BAP are similar to other recently approved BAP's. <br /> Those terms are as follows: <br /> • The City would rebate 40% of the incremental sales tax revenues derived from <br /> the imposition of the City's 3.0% general sales tax over a three year period. <br /> • Incremental assistance would NOT be provided if 100-Mile Mercantile has not <br /> commenced operation on or before October 1, 2012. <br /> • The total assistance would be capped at $17,000.00. <br /> • The City would receive full permit fees and construction use tax. <br /> • The maximum three-year rebate would run concurrently with the opening and <br /> first three years of operation. <br /> • In the event that within 3 years of the commencement of the rebate term, this <br /> store terminates their business for any reason, Owner will pay back the total <br /> amount of sales tax rebated by the City. <br />
