Louisville City Council Meeting <br />July 5, 2000 <br />Page 4 <br /> <br />the Resolution also include a statement authorizing the Mayor to negotiate the access <br />right-of-way. <br /> <br />Sisk asked Hill who owns the property. <br /> <br />Hill stated that the Fickbohms are joint property owners and that he would forward a <br />copy of the title to the City Attorney. <br /> <br />MOTION: Sisk moved that Council adopt Resolution No. 36, Series 2000, and authorize <br />the Mayor to negotiate any changes that would be necessary in granting a revocable <br />license, including but not limited to, a mutual license agreement from the Fickbohm's <br />allowing the City to utilize the easement, seconded by Keany. <br /> <br />Howard noted that them were two other concerns 1) the agreement between City and <br />LFPD, and 2) consent to use the right-of-way, not addressed in the motion. <br /> <br />Sisk stated that those two issues would be included in the Mayor's authorization to <br />negotiate. <br /> <br />Sam Light, City Attorney stated that Resolution No. 35, Series 2000, includes a <br />requirement that the applicant convey the right of ingress/egress to the LFPD. He noted <br />that the conveyance may take the form of a license agreement or some other type of <br />grant. <br /> <br />ACTION ON THE MOTION: All in favor. <br /> <br /> RESOLUTION NO. 34, SERIES 2000 - A RESOLUTION DISAPPROVING <br />AN AMENDED FINAL PUD DEVELOPMENT PLAN AND SPECIAL REVIEW <br />USE FOR PEAK TO PEAK CHARTER SCHOOL, LOTS 1 & 2, BLOCK 5, CTC, <br /> 1812 BOXELDER STREET <br /> <br />Council members Howard and Levihn recused themselves from any discussion or voting <br />on Resolution No. 34, Series 2000. <br /> <br />Davidson asked the City Attorney to review the Special Review Use criteria and the <br />procedures of the public hearing. <br /> <br />4 <br /> <br /> <br />
