Louisville City Council Meeting <br />July 5, 2000 <br />Page 5 <br /> <br />Sam Light, City Attorney reviewed the Special Review Use criteria, and the procedure <br />that would be observed in conducting the public hearing. He noted that the Special <br />Review Use request and the Final Development Plan will be heard and considered at the <br />same time. He stated that the Special Review Use is to permit a school within an <br />Industrial zoned district. Light reviewed that the Council may approve or deny the <br />application, or may approve the application with conditions or modifications. The City <br />Council also has the authority to return the proposal back to the Planning Commission for <br />further review. Light reviewed that any decision made, must be by a majority of the <br />Council members who vote. Light noted that the proceeding is not a repeal of the <br />Planning Commission's denial, instead it is final action by City Council on the <br />applications. Light noted that the information to be considered in reviewing the <br />applications is not limited to the information presented to the Planning Commission. <br />Instead, the applicant, City Staff, persons supporting or opposing the application, or any <br />other person may present additional testimony. Council's review of this application is a <br />quasi-judicial matter. <br /> <br />Light reviewed the general order of the proceeding will be a presentation by City Staff, <br />followed by the applicant's presentation. Council will then take comments from persons <br />who wish to speak for or against the application. Persons wishing to speak must <br />complete a Sign-up card and provide the same card to the City Clerk prior to speaking. <br />Once the testimony is complete the Council will ask questions of the applicant and staff <br />and the applicant may make a closing remark. Rules of evidence do not apply in these <br />proceedings. All testimony and written documents presented will be part of the record of <br />the Council's proceedings. <br /> <br />Light requested that the City Council include in the record, all application materials <br />submitted by the applicant, all materials included in the City Council packets, all minutes <br />of the Planning Commissions hearings and discussions on the applications, the City <br />Zoning Ordinances and Map, the Louisville Comprehensive Plan and any other public <br />records in Planning Department files, related to the proposed Special Review Use and <br />PUD for Peak to Peak Charter School. He asked Council to include all materials through <br />a motion. <br /> <br />Sisk moved that Council include all documents outlined by the City Attorney in the <br />record, Mayer seconded. All in favor. <br /> <br />Davidson called for Staff presentation <br /> <br />Planning Director Wood stated that his summary comments would be organized around <br />the discussion of the following: The use, the description of the property, the Planning <br />Commission recommendations, the issues raised as a result of the Planning Commission <br /> <br /> <br />
