Motion passed by a vote of 6-0. <br /> <br />ORDINANCE NO. 1340 SERIES 2000 - AN EMERGENCY ORDINANCE <br />AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO <br />EXCLUDE TWO OR MORE PERSONS WHO ARE REGISTERED SEX <br />OFFENDERS FROM LIVING TOGETHER WITHIN RESIDENTIAL AREAS - <br />2ua reading - public hearing (advertised Daily Camera 06/25/00) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />Sam Light, City Attorney read Ordinance No. 1340, Series 2000. <br /> <br />Davidson called for Staff presentation. <br /> <br />City Administrator Bill Simmons summarized the proposed emergency ordinance <br />amending the Louisville Municipal Code (LMC) to regulate the operation of group <br />homes for sex offenders in residential neighborhoods. The ordinance amends LMC <br />Section 17.08.150 to exclude from the definition of "family," two or more unrelated <br />adults who are required under C.R.S. Section 18-3-412.5 to register as sex offenders. <br />This amendment to the definition of what constitutes a family, is in conformity with how <br />other Front Range municipalities have regulated and prohibited the cohabitation of two or <br />more registered sex offenders in residential neighborhoods. <br /> <br />The ordinance amends LMC Section 17.16.140 by adding a new Subsection D, to <br />expressly state that any type of group home which may be permitted within a <br />residentially zoned area may not be occupied by more than one registered sex offender. <br />The ordinance amends LMC Section 17.16.140.B. adding boardinghouse and lodging <br />house to this prohibition. <br /> <br />The Planning Commission, at its July 11, 2000 meeting, approved Ordinance No. 1340, <br />Series 2000 by a vote of four to three (4-3). Those members recommending approval <br />believe the City needs to protect the community, given the fact that other jurisdictions <br />have adopted more restrictive regulations. Those opposing the ordinance expressed <br />reservations adopting the ordinance without more information or testimony from <br /> <br />16 <br /> <br /> <br />
