Louisville City Council Meeting <br />August 1, 2000 <br />Page 10. <br /> <br />City Attorney Light stated that it is appropriate to add those notes to the PUD, however <br />the use limitations under the existing water use ordinances should address this either by <br />requiring additional water rights, a larger tap, or something of that nature. <br /> <br />Phare stated that water use might be asked for in Phase II, however there is no <br />representation for additional water use in Phase I. Phare stated that the City could inspect <br />the facility prior to the issuance of a Certificate of Occupancy and do unscheduled <br />inspections to ensure no changes have been made. <br /> <br />Sisk stated he would like to see assurances in writing, such as an amendment to the PUD. <br /> <br />Davidson suggested amending the Resolution to include the agreement. <br /> <br />Light stated that an approval of the Resolution would in no way authorize the bottling of <br />City water. <br /> <br />Sisk asked Light if American Veriseal has a right to apply, or had any vested rights. <br />Light stated that American Veriseal does not have any statutory vested rights. Light <br />explained that as long as the owner is the applicant, they have a right to pursue a new <br />application. Light stated that there cannot be two pending approvals on the same <br />property. Light stated that a note can be made on the PUD. <br /> <br />Terry O'Connor, O'Connor Development, LLC., 6685 Gun Park Drive, Boulder, CO, <br />stated that American Veriseal did not close on the land, nor did they record any <br />documents regarding the approval. <br /> <br />MOTION: Mayer moved that Council approve Resolution No. 44, Series 2000, with <br />an additional condition that no water from the Louisville water supply system be used <br />for either bottled water or water products, seconded by Levihn. <br /> <br />Light offered a friendly amendment adding a condition 4/3 that would read "bottling of <br />City water is not permitted under this authorization." "Any such use shall require a <br />separate written authorization of and in agreement with the City." A note stating the <br />same should be added to the PUD. <br /> <br />Mayer stated that he would like to add "other bottled water products." Levihn accepted <br />the amendment. <br /> <br />VOTE: Roll call vote was taken. Motion passed by a vote of 5-0. <br /> <br />10 <br /> <br /> <br />
