Louisville City Council Meeting
August 1, 2000
Page 9.

Davidson called for Applicant presentation.

Frank Marceau, O'Connor Development LLC, 287 Century Circle, Louisville, CO stated
that he was available to answer any of Council's questions. He extended his thanks to
Planning Director Wood, Public Works Director Phare and the City Staff for their
assistance. He introduced the applicant, Mr. Kevin Sipple.

Kevin Sipple, Chairman of Eldorado Artesian Springs, Inc., Eldorado Springs, CO, stated
that they are pleased and excited to locate in the CTC Park in Louisville. He also
expressed his thanks to the City Staff and stated that they have been very helpful. He
asked that Council approve their plan.

COUNCIL COMMENTS:

Mayer voiced his concerns about the water source and water tap-fee and suggested that
the PUD reflect a note as to the agreement.

Sipple stated that their basic building water needs are standard, the bathrooms and
irrigation of lawns and for this they will purchase a water tap. For the purpose of
professional bottled water uses, which may be developed, they have a set agreement that
any water used for bottled water will be replaced by other water rights.

Public Works Director Tom Phare stated that this would be addressed in Phase II, which
would not replace the tap fees, but would be in addition to a tap fee. This would make up
for any additional water used.

Mayer suggested an amendment to state that any impacts of this kind would be subject to,
and agreed upon by the applicant and the City of Louisville and noted on the PUD.

Levihn asked the applicant if they would comply with the two remaining conditions.
Sipple stated that both of the remaining conditions have been addressed and will be in
compliance.

Sisk stated that he was happy to see Eldorado Artesian Springs Water locate in
Louisville. He voiced concern however, to the amendment to the PUD and the
subsequent use of Louisville water. He asked if the present plan ensures Louisville will
be protected.

Sipple stated that they have an agreement that they will not go forward without City
approval and they have agreed to be inspected by the Public Works Department.

9
