Louisville City Council Meeting <br />August 15, 2000 <br />Page 10. <br /> <br />Howard asked if the Madani property assessed valuation was acquired for BID approval. <br />BID Attorney Grimshaw stated that only the acreage was required. Grimshaw explained <br />that Madani signed the petition because he believed it was good for the community, but <br />wishes to be excluded from the district. <br /> <br />Howard asked City Attorney Light, if the emergency ordinance was not granted, would <br />the BID meet the legal requirement for the November election. Light stated that if the <br />ordinance were approved as an emergency ordinance, the BID Board could be seated, <br />organized and be prepared to meet the certification of the ballot deadline for the County <br />election in November. Grimshaw reviewed the two deadline the BID must meet: 1) Sign <br />the IGA for the County Coordinated Election by September 8, 2000. 2) Certify the <br />ballot question by September 13, 2000. <br /> <br />Mayer asked City Attorney Light to clarify the question with respect to the BID's ability <br />to increase in the mill levy without a vote. Light stated that the BID would be a political <br />district and would have to submit any tax increase to a vote of the district. Grimshaw <br />stated that the district cannot levy any tax without City Council approval. He explained <br />that every year an operating plan and budget must be submitted and approved by the City <br />Council. Therefore, the district cannot certify any levy without City Council approval. <br /> <br />Mayer asked if the BID would be subject to Tabor limitations. Grimshaw stated that they <br />would be subject to Tabor limitations. <br /> <br />Brown commended the Downtown Business Association for their hard work. He asked if <br />the eight residential properties were excluded, would the percentage change to bring the <br />BID below what is required. Grassi stated that the County sent a letter which confirms the <br />change in classifications of two properties and that the City Clerk has verified those <br />percentages. She stated she believed that they are still within the required percentages. <br />City Clerk Varra confirmed that the BID is within the required percentages and stated <br />that those two properties were verified and included. <br /> <br />Brown supported Riggins concerns that all funds would be used administratively. <br />Barnett stated that the administrative budget would be used to administer all advertising. <br /> <br />Levihn stated that the proponents of the BID have done a good job and noted that the <br />BID will be good for downtown Louisville. He stated that he wanted the process to move <br />forward to a vote of the property owners. <br /> <br />Mayer stated that he respected all the hard work that went into the BID process and based <br />on the petitions that were signed, that a vote to the property owners is appropriate. He <br />commented that it is an organizational opportunity to promote Downtown Louisville. <br /> <br />10 <br /> <br /> <br />
