Louisville City Council Meeting <br />September 5, 2000 <br />Page 15. <br /> <br />MOTION: Keany moved that Council approve Resolution No. 45, Series 2000, <br />striking Condition 2., seconded by Levihn. <br /> <br />Davidson offered a friendly amendment to condition 5. of Resolution 45, to read "The <br />secondary access easement shall be graded and resurfaced "and a signed enforceable <br />maintenance agreement obtained" in accordance with the requirements of the Louisville <br />Fire Protection District prior to foundation inspection for Lot 13, Block 4. <br /> <br />Keany and Levihn accepted the amendment. <br /> <br />Roll call vote was taken. Motion passed by a vote of 6-1. Howard voted no. <br /> <br />RESOLUTION NO. 51, SERIES 2000 - A RESOLUTION CONCERNING A <br />PETITION FOR THE ANNEXATION OF PROPERTY TO THE CITY OF <br />LOUISVILLE, COLORADO, KNOWN AS THE FISCHER ANNEXATION, AND <br />FINDING THE AREA PROPOSED TO BE ANNEXED ELIGIBLE FOR <br />ANNEXATION - public hearing <br /> <br />Davidson called for City Attomey comments. <br /> <br />City Attorney Light stated that Agenda Items 6C 1-6C2 relate to the Fischer annexation. <br />He noted that Staff has advertised the public hearing for both questions of annexation and <br />zoning. He noted that it is appropriate to open the public hearing and take all comments <br />at one time on both the zoning and annexation issues. <br /> <br />Davidson opened the public hearing and called for Staff presentation. <br /> <br />Planning Director Wood reviewed Resolution No. 51, and stated that Staff and the City <br />Attorney's office have reviewed the petition and map and find them, as revised, to be in <br />compliance with statutory requirements. <br /> <br />Wood reviewed that Ordinance No. 1444, Series 2000, approving an annexation known <br />as the Fischer Annexation. The landowner/applicant Mrs. Jobelle Fischer (Fischer Farms <br />Development-LLC) is petitioning the City to commence a voluntary annexation of <br />approximately 7.6 acres, located at 701 West Spruce Street. Wood noted that Resolution <br />No. 43, Series 2000, the resolution of substantial compliance was approved by City <br />Council on August 1,2000, and a public hearing on the annexation was set for September <br />5, 2000. <br /> <br />15 <br /> <br /> <br />
