Planning Commission <br />Staff Report <br />January 12, 2012 <br />According to the submittal, the applicant has dedicated a total of 1.4 acres towards <br />public land dedication. as detailed below: <br />• Unencumbered public land dedication:.39 acres <br />• Encumbered public land dedication: .76 acres <br />• Outlot B: .2 acres <br />• Tract 0 (Takoda Subdivision):.25 acres <br />Tract O, which is a tract from the previously approved Takoda Subdivision, was originally <br />dedicated as an emergency access and private open space for trail connection. In this <br />submittal the applicant is dedicating the land to the City for trail connection to the future <br />regional trail system. The Parks and Recreation Department will continue to work with <br />the applicant on the dedication of Tract O. from the Takoda Subdivision, as public land <br />dedication. <br />The City requires the public land dedication be free of encumbrances. However, <br />because the land being dedicated will be used to complete a key link in the City's open <br />space and regional trail connection. and the encumbrances are the existing Davidson <br />Highline Ditch, existing Public Service easement and an existing 40' utility easement, the <br />Parks and Recreation Department is recommending Planning Commission recommend <br />and City Council accept the encumbered land as the last remaining piece of a larger <br />open space area and key recreational trail connection. <br />pavidson Hiqhline Canal/Goodhue Ditch <br />As shown in the preliminary Plat and PUD, the Davidson Highline Canal, located within <br />Outlot 3, will be retained within a 50' wide utility easement and treated as a design <br />feature. The applicant has been working with both the Davidson Highline and Goodhue <br />Ditch companies to determine whether or not piping of the ditch is preferred. Staff <br />recommends the applicant continue to work with the ditch companies to insure all of their <br />interests are met by Final Plat and PUD. <br />Buffington Northern/Santa Fe <br />The development is located adjacent to the Burlington Northem/Santa Fe rail line. The <br />applicant Is taking steps necessary to provide noise mitigation for their development. <br />MACS has generated a site plan which utilizes Steel Street right of way as buffer space <br />for the residential product type. From the edge of the BNSF right of way, there is <br />approximately 80 feet of separation between the nearest single family structures. <br />The applicant has also stated `multi -family units within 100 feet of the railroad right of <br />way will incorporate noise mitigation via enhanced wall construction and window <br />specification, including a minimum exterior wall Sound Transmission Coefficient of 55 <br />facing the railroad right of way, with tight fitting triple pane windows. and solid core <br />doors' The nearest multi -family structure is located within 70 of the rail right of way. <br />8 <br />
