City Council <br /> Meeting Minutes <br /> May 1, 2012 <br /> Page 4 of 17 <br /> Sarah Jarman, 302 Spruce Street, Louisville, CO thanked Council for considering her <br /> Business Assistance Package and Economic Development Director DeJong and <br /> Deputy City Manager Balser for their quick response. She explained she has looked at <br /> several franchise opportunities and decided upon LePeep as it would work well with <br /> Louisville. She is continuing to work with the property's landlord on a lease agreement. <br /> MOTION: Council member Sackett moved to approve Resolution No. 31, Series 2012, <br /> seconded by Council member Jasiak. Roll call vote was taken. The motion carried by a <br /> vote of 7-0. <br /> RESOLUTION No. 25, SERIES 2012 — A RESOLUTION APPROVING A <br /> PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) AND SPECIAL REVIEW <br /> USE (SRU) TO PERMIT THE CONSTRUCTION OF FIVE (5) BUILDINGS, THREE (3) <br /> OF WHICH WILL CONTAIN A TOTAL OF 180 APARTMENT UNITS AND <br /> STRUCTURED PARKING, AND TWO (2) OF WHICH WILL CONTAIN 10,000 <br /> SQUARE FEET OF RETAIL DEVELOPMENT, ON TRACT ONE OF THE LOUISVILLE <br /> NORTH, FILING 7 SUBDIVISION LOCATED AT 707 E. SOUTH BOULDER ROAD <br /> Mayor Muckle explained this matter comes before the Council with a recommendation <br /> from the Planning Commission of denial. He indicated this is a public hearing and the <br /> City Council will receive public testimony until 10:00 p.m., and if necessary, continue the <br /> public hearing until the next regular Council meeting on May 15, 2012. The order of the <br /> hearing will begin with a staff presentation, then a presentation by the applicant and <br /> public comment. If the item is continued to May 15th, further public comment can be <br /> made before Council makes their final decision. <br /> City Attorney Light requested, the City Council, by motion, include into the record of the <br /> proceeding the following documents: all the application materials submitted by the <br /> applicant in connection with the subdivision, the Planned Unit Development request and <br /> the Special Review request, all information included in the City Council packets, which <br /> consists of the City Council staff report and a number of attachments, all written referral <br /> and public comments received in regard to the application, including the documents <br /> received this evening, which are additional emails, the City Comprehensive Plan, City <br /> Subdivision and Zoning Ordinances, which are included in the Chapters 16 and 17 of <br /> the Louisville Municipal Code. <br /> MOTION: Mayor Pro Tem Dalton moved to enter all the materials as outlined by the <br /> City Attorney, into the record, seconded by Councilor Jasiak. All were in favor. <br /> City Attorney Light requested any additional materials, including the applicant's <br /> PowerPoint presentation and from the public be submitted to the City Clerk to be <br /> incorporated in the record of the proceedings. <br /> A public member questioned the process set for the public hearing. City Attorney Light <br /> explained the Council has not adopted and is not bound by Robert's Rules of Order. <br />
