Ray <br />stated that a new fee schedule is proposed for March of 2001. <br /> <br />MOTION: Mayer moved that Council approve Ordinance No. 1350, Series 2000, <br />seconded by Keany. Roll call vote was taken. The motion passed by a vote of 5-0. <br />Absent: Howard, Sisk excused. <br /> <br />ORDINANCE NO. 1351, SERIES 2000 - AN ORDINANCE CONSENTING TO <br />THE TRANSFER OF THE CABLE TELEVISION FRANCHISE FROM <br />COMCAST CORPORATION TO TCI ATLANTIC, INC., DOING BUSINESS AS <br />AT&T BROADBAND - 2"a reading - public hearing (advertised Daily Camera <br />11/12/00) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1351, Series 2000. <br /> <br />Davidson called for Staff presentation. <br /> <br />Heather Balser, Assistant to the City Administrator, reviewed that AT&T Broadband and <br />lnternet Services ("AT&T") has announced its intention to acquire Comcast Corporation, <br />and has requested a transfer of the Cable Television Franchise Agreement. <br /> <br />Balser noted that the City of Louisville and Scripps Howard Cable Company entered into <br />a franchise agreement on September 18, 1995, for a term of ten years. In early 1996, <br />Comcast acquired control of Scripps Howard, and Comcast requested and received the <br />City's approval of this change in control and transfer of the franchise agreement to <br />Comcast. On August 29, 2000, AT&T filed with the City, a Federal Communications <br />Commission Form 394, requesting the City's approval of another transfer of the franchise <br />agreement from Comcast to AT&T. <br /> <br />Balser noted that the City Attorney's Office has reviewed AT&T's FCC Form 394, to <br />ensure that it contains the terms and information required by law. The franchise <br />agreement and federal law require the City to approve or deny the request to transfer the <br />franchise agreement within 120 days or the City's approval is granted. Therefore, the <br />City must approve or deny the requested transfer no later than December 27, 2000. <br /> <br />Davidson called for Applicant presentation. <br /> <br />Comcast declined presentation.
