Louisville City Council Meeting <br />November 21, 2000 <br />Page 7. <br /> <br />City Attorney Light read Ordinance No. 1352, Series 2000. Light requested approval of · <br />one second reading amendment. He explained that after first reading, a legal description <br />was received. He asked that on the document entitled "Vacation of Easement", a <br />reference be added that the area being vacated is more particularly described in Exhibit <br />"A", which is the legal description. Light asked that amendment be included in the <br />motion. <br /> <br />Davidson called for Staff presentation <br /> <br />Planning Director Paul Wood reviewed that on September 5, 2000, City Council <br />approved Resolution No. 45, Series 2000, authorizing a Final PUD Development Plan for <br />Lot 13 and an Amended Final PUD Development Plan for lots 14 and 15, Block 4, CTC <br />First Filing. The approved PUD authorized the applicant (McBride Brothers) to move <br />forward in the construction of a 28,543 SF new industrial building on Lot 13 located at <br />1815 Boxelder Street. As a condition of Resolution No. 45, Series 2000, the applicant is <br />required to vacate the 60' wide access easement, currently located on Lots 13 and 14, <br />Block 4, Colorado Tech Center Filing No. 1, prior to the issuance of a building permit for <br />Lot 13. The access easement was intended to provide an opportunity for vehicle access <br />between Boxelder Street and the Hoyle property which is an unincorporated parcel of <br />approximately 33 acres located adjacent to, and south of Lots 13 and 14, Block 4. <br /> <br />Davidson called for Applicant presentation. <br /> <br />Paul R. Pennock, Zeiler-Pennock, Inc. 2727 Bryant Street, Suite 600, Denver, CO, <br />Architect representing the McBride Brothers, stated they have submitted the legal <br />description and that he was available to answer Council questions. <br /> <br />Davidson opened the public hearing and asked if anyone in the audience wished to speak <br />in favor or against Ordinance No. 1352, Series 2000. <br /> <br />Tom Metzger, Community Development Group, Boulder, CO, asked if the easement is <br />vacated, would that shift the responsibility to other property owners to access from <br />Boxelder Street to Dillon Road. <br /> <br />Pennock stated that the extension of Boxelder Street will probably be accomplished <br />through an extension to 104th Street. He noted that at this time, it is not contemplated to <br />go south through the unincorporated property. <br /> <br />Davidson closed the public hearing. <br /> <br /> <br />
