City Council <br /> Meeting Minutes <br /> July 3, 2012 <br /> Page 5 of 12 <br /> Planning Director Russ stated this is a request by applicant, Jacques Blanchard, to <br /> amend the Rex Theater Planned Unit Development (PUD) to construct three windows <br /> on the northern façade of the existing building. Section 17.28.220 of the Louisville <br /> Municipal Code (LMC) requires that any changes to a completed PUD, which are not <br /> minor in nature, be made by the Planning Commission and City Council under the same <br /> procedures for final development plan approval. <br /> The applicant proposes to place three 48" X 48" windows on the north façade of the <br /> existing building. The main potential impact by the addition of windows on the northern <br /> façade is to the privacy of the neighbors to the west of the site. <br /> The application was heard by the Planning Commission on June 14, 2012. The <br /> commissioners discussed the privacy issues and ultimately voted 3-1 to recommend <br /> approval of the application. The Commissioners who voted to recommend approval of <br /> the application were sympathetic to the neighbors' concerns but felt the windows were a <br /> minimally intrusive addition in a neighborhood which backs to an alley adjacent to <br /> downtown. <br /> Director Russ stated there had been an amendment to the resolution which had been <br /> agreed upon but was not stated in the resolution in the original packet. Council was <br /> given copies prior to the meeting. The change states the windows would be allowed <br /> with one condition: Prior to recordation of the PUD amendment the applicant shall add <br /> a note to the document which states `If the property to the north of 817 Main Street is <br /> redeveloped with a structure that is located within five feet of the building at 817 main <br /> Street, the owner of the property will work with the Chief building official of the city of <br /> Louisville to make the necessary changes to bring the windows approved as a part of <br /> this PUD into compliance with current building and fire codes". <br /> APPLICANT PRESENTATION <br /> Applicant Jacques Blanchard, 855 West Dillon Road, Louisville, CO said he agreed if <br /> the lot next door has a building built on it closer than five feet, there would be no need <br /> for the windows and would have no problem putting the wall back. He stated he had <br /> withdrawn his request for a sign on this side of the building. The neighbor with line of <br /> sight concerns agreed to trees, provided by Mr. Blanchard, being planted in their yard. <br /> Council member Loo thanked the applicant for working with the neighbor. <br /> PUBLIC COMMENT <br /> Mayor Muckle asked for public comment and hearing none called for Council comment. <br /> COUNCIL COMMENT <br />
