Louisville City Council Meeting <br />January 16, 2001 <br />Page 12. <br /> <br />MOTION: Sisk moved that Council approve the Resolution No. 4, Series 2001, <br />seconded by Mayer. Roll call vote was taken. The motion carded by a vote of <br />7-0. <br /> <br />RESOLUTION NO. 5, SERIES 2001 - A RESOLUTION AUTHORIZING THE <br />EXECUTION AND DELIVERY OF A CONSTRUCTION CONTRIBUTION <br />AGREEMENT, BY AND BETWEEN THE CITY OF LOUISVILLE, COLORADO <br />AND THE HUMANE SOCIETY OF BOULDER VALLEY, INC.; THE <br />EXECUTION AND DELIVERY OF AN AGREEMENT FOR ANIMAL <br />IMPOUNDMENT SERVICES, BY AND BETWEEN THE CITY AND THE <br />HUMANE SOCIETY; THE APPROPRIATION OF CERTAIN MONEYS FROM <br />THE CITY TO BE PAID TO THE HUMANE SOCIETY IN CONNECTION <br /> WITH SUCH AGREEMENT; THE TAKING OF ALL ACTIONS AS ARE <br /> NECESSARY IN CONNECTION WITH THE EXECUTION OF SUCH' <br /> AGREEMENT AND THE APPROPRIATION OF SUCH MONEYS; AND THE <br /> RATIFICATION OF CERTAIN ACTIONS HERETOFORE TAKEN <br /> <br />Davidson called for Staff presentation. <br /> <br />Assistant to the City Administrator Heather Balser stated that Resolution No. 5, Series <br />2001 authorizes the most current Construction Contribution Agreement and Agreement <br />for Animal Impoundment Services between the City of Louisville and the Humane <br />Society of Boulder Valley. Balser noted that City Attorney Sam Light has reviewed the <br />document and suggested a number of revisions. Attorneys for the Humane Society have <br />agreed to all such changes and the attached documents have been edited to reflect the <br />City Attorney's comments. <br /> <br />Balser stated that the City's net present value contribution to the cost of constructing a <br />new shelter and treatment facility is $111,045. The City shall pay the Present Value <br />Contribution in full to the Human Society on January 31,2001. <br /> <br />Balser stated that the documents do not include language regarding a Reserve Fund for <br />the payment of certain repair and replacement costs of the Facility. Previous drafts stated <br />that, in addition to the City's construction contribution, the City shall also pay to the <br />Humane Society, as the City Reserve Fund contribution, 18 annual payments of $2,221 <br />each, commencing on January 31, 2003 and continuing through January 3t, 2020. After <br />discussion with the Boulder Valley Humane Society representation at the January 9, 2001 <br />work session, City Council requested that the language be removed and that <br /> <br />12 <br /> <br /> <br />
