<br />City Council <br />Meeting Minutes <br />December 6, 2005 <br />Page 14 of 16 <br /> <br />The City Attorney requested the City Council convene an executive session for <br />the purpose of consultation with respect to pending litigation and potential <br />settlement (Kenneth E. Sawyer, et. AI. v City of Louisville, Civil Action No. <br />2005CV52, Boulder County District Court Division 5). <br /> <br />City Clerk Varra read Section: 2.90.050 Public Statement, of the Louisville <br />Municipal Code, which governs the topics that can be discussed during an <br />executive session. <br /> <br />MOTION: Mayor Sisk moved the Council suspend regular business items to <br />meet in executive session to discuss pending litigation; Kenneth E. Sawyer, et. <br />AI. v City of Louisville. Mayor Pro Tem Brown seconded the motion. All in favor. <br /> <br />Regular business items were suspended at 9:37 p.m. <br /> <br />REGULAR BUSINESS ITEMS CONTINUED <br /> <br />Mayor Sisk reconvened the regular business meeting at 10:17 p.m., and <br />requested a report on the executive session. <br /> <br />REPORT BY CITY ATTORNEY FROM EXECUTIVE SESSION - <br />(Kenneth E. Sawyer, et. AI. v City of Louisville, Civil Action No. 2005CV52, <br />Boulder County District Court, Division 5) <br /> <br />City Attorney Light reported at the executive session was for the purpose of <br />consultation with an attorney regarding pending litigation, Sawyer v the City of <br />Louisville, which involved the disputed right-of-way of Front Street. In executive <br />session, Council discussed the settlement proposal and a settlement strategy. <br />City Attorney Light requested Council authorization to prepare the documents for <br />the potential settlement in this matter. The document would be prepared and <br />brought back before Council for their consideration. <br /> <br />MOTION: Mayor Pro Tem Brown moved Council direct the City Attorney to <br />proceed with the preparation of the settlement document. The motion was <br />seconded by Council member Muckle. All in favor. <br /> <br />City Attorney Light noted there would be a couple of agenda items relative to the <br />settlement agreement. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Light addressed his memo regarding a lawsuit filed by Capitol <br />Resources Publishing Press relative to the release of police accident reports. <br />
