<br />City Council <br />Meeting Minutes <br />December 20, 2005 <br />Page 6 of 8 <br /> <br />MOTION: Council member Muckle moved for Council approval of the budget for <br />the library furniture, millwork and shelving. Council member Marsella seconded <br />the motion. Roll call vote was taken. The motion carried by a vote of 7-0. <br /> <br />REGULAR BUSINESS ITEMS SUSPENDED <br /> <br />The City Attorney requested the City Council convene an executive session for <br />the purpose of consultation with respect to pending litigation (City of Louisville, <br />Colorado and Nancy Varra. City Clerk v. Capitol Resources Corporation d/b/a <br />Colorado Free Press, and James Donato, Case No. 2004CV1527 -5, Boulder <br />County District Court). <br /> <br />City Clerk Varra read Section: 2.90.050 Public Statement, of the Louisville <br />Municipal Code, which governs the topics that can be discussed during an <br />executive session. <br /> <br />MOTION: Mayor Sisk moved the Council suspend regular business items to <br />meet in executive session to discuss pending litigation; City of Louisville, <br />Colorado and Nancy Varra, City Clerk v. Capitol Resources Corporation d/b/a <br />Colorado Free Press, and James Donato, Case No. 2004CV1527 -5, Boulder <br />County District Court. He requested Chief Goodman and City Clerk attend the <br />executive session. Mayor Pro Tem Brown seconded the motion. All in favor. <br /> <br />Regular business items were suspended at 8:00 p.m. <br /> <br />REGULAR BUSINESS ITEMS CONTINUED <br /> <br />Mayor Sisk reconvened the regular business meeting at 8:40 p.m., and <br />requested the City Attorney report on the executive session. <br /> <br />REPORT BY CITY ATTORNEY FROM EXECUTIVE SESSION- <br /> <br />City Attorney Light reported the executive session was for the purpose of <br />consultation with an attorney regarding pending litigation. In executive session, <br />Council discussed litigation strategy for the pending lawsuit of The City of <br />Louisville, Colorado and Nancy Varra, City Clerk v. Capitol Resources <br />Corporation d/b/a Colorado Free Press, and James Donato, Case No. <br />2004CV1527 -5, Boulder County District Court. Discussion was confined to <br />options for further proceedings in that case and Council direction on how to <br />proceed. <br /> <br />Mayor Sisk asked City Attorney Light if he was satisfied with the direction he <br />received from Council. City Attorney Light confirmed he was and will proceed in <br />accordance with Council direction. <br />
