Louisville City Council Meeting <br />April 3, 2001 <br />Page 11 <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 4-2. Mayer and Sisk <br />voted no. <br /> <br />RESOLUTION NO. 24, SERIES 2001 - A RESOLUTION OF SUBSTANTIAL <br />COMPLIANCE - MAURER ANNEXATION - set public hearing for May 15, 2001 <br /> <br />Davidson called for Staff presentation. <br /> <br />Planning Director Wood stated that the resolution of substantial compliance is the first <br />step in the annexation process. He stated that the landowners/applicants, Mr. and Mrs. <br />James A. Maurer, are petitioning the City to commence a voluntary annexation of <br />approximately 1.156 acres. Mr. and Mrs. Mauer have submitted an annexation petition to <br />initiate voluntary annexation of their property located approximately 600 feet east of the <br />intersection of S. 88th Street and Dillon Road, on the north side of Dillon Road. <br /> <br />Wood noted that the Resolution does find that the annexation is in statutory compliance <br />and that the annexation is able to move forward. The property has 59 percent contiguity <br />with the City of Louisville, which exceeds the minimum statutory requirement. Wood <br />noted that the property is currently undeveloped. <br /> <br />Wood reported that Resolution No. 24, Series 2001, if authorized, sets the public hearing <br />date on the annexation for May 15, 2001. The property owner is requesting that the <br />property be zoned to Single Family Estate (SF-E) in conjunction with the annexation. <br />The SF-E district requires a minimum lot area of one (1) acre. The current property <br />owner is seeking to sell the subject property to Todd and Calla Lovrien who propose to <br />plat the subject property for one single-family home site. Wood noted that if authorized <br />by City Council, the annexation and zoning will come before the Planning Commission <br />on April 10, 2001. <br /> <br />Wood stated that the applicant is requesting a condition that would allow access from St. <br />Andrews, in Coal Creek Ranch Filing 4, and connect to a City Open Space Outlot to the <br />south of the property line. He noted the concern is that the proposed location of the <br />access will cross the Coal Creek regional trail system and through the City open space. <br />He noted that there is not sufficient access on Dillon Road; or support from Staff to <br />provide such access due to of limited sight visibility, location and traffic flow. He stated <br />that the applicant will come forward with that request. <br /> <br />Davidson called for Applicant presentation. <br /> <br />John Mehaffy, Martin & Mehaffy, 1125 Foxhill Drive, Longmont, CO, stated that he is <br />the Attorney representing the applicants. He reviewed the background of the parcel and <br />stated that initially the Maurer's intended to build three homes on the one acre parcel, <br /> <br />11 <br /> <br /> <br />
