Balser reported that Staff has had discussion with the <br />Chair and Vice-Chair of the Louisville Citizens Open Space Advisory Board, and they <br />had no comments. <br /> <br />Light reviewed a map, which illustrated the disconnection of the parcels. He stated that <br />the out-of-bound parcels legal descriptions in the ordinance are excluded from the <br />disconnection by the yellow highlighted area (the old alignment of the Northwest <br />Parkway), which will remain unincorporated for the time being. The ordinance will also <br />exclude the hatched marked area (the new alignment of the Northwest Parkway). Light <br />noted the ordinance amendments to the legal description to clarify those points of <br />exclusion. He asked that on second reading of the ordinance, if approved, it be approved <br />with Exhibit A. amendments. Light noted that the Exhibit has been revised with respect <br />to parcels 1 and 2 to reflect the City's ownership interest. <br /> <br />COUNCIL COMMENTS <br /> <br />Sisk asked for clarification that the yellow and hatched marked areas of the map (the old <br />and new alignment of the Northwest Parkway) would remain within the City of <br />Louisville, and the balance would be disconnected. Light confirmed that the yellow and <br />hatched marked areas would remain within the City. <br /> <br />City Administrator Simmons stated that the transaction for the Northwest Parkway right- <br />of-way is an ongoing activity. The area highlighted in yellow is now owned by the City <br />of Broomfield. It is the intention to transfer that area to the Northwest Parkway Highway <br />Authority. Simmons stated that with Council direction, he would work with the City of <br />Broomfield and the Northwest Parkway. <br /> <br />Sisk asked for clarification that if, the City proceeded forward with the disconnection, <br />they would not lose control of the properties' open space conservation easements. <br />Light confirmed Councilman Sisk's statement and stated that those transactions are also <br />noted on the map. Light stated that there is one final transaction, and that is the <br />annexation of parcel 3, which is further to the east~ He noted that eventually there will be <br />a merging of all properties, and each party will receive half interest in all the properties. <br /> <br />Sisk asked if the disconnection is in compliance with the IGA of the Northwest Parkway. <br />Light responded yes to Councilman Sisk's question. Light explained the original <br />agreement of the Northwest Parkway is not final, however, the land use descriptions <br />remain the same as in the original IGA of the Northwest Parkway. <br /> <br />MOTION: Mayer moved that Council approve Ordinance No. 1360, Series 2001, as <br />amended, seconded by Levihn. <br /> <br />6 <br /> <br /> <br />
