Louisville City Council Meeting <br />June 5, 2001 <br />Page 7 <br /> <br />City Attorney Light offered the following friendly amendment: "as amended in both the <br />legal descriptions in Exhibit A and upon condition that the final legal description for the <br />realignment be added prior to publication." <br /> <br />Mayor and Levihn accepted the friendly amendment. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 7-0. <br /> <br />RESOLUTION NO. 27, SERIES 2001 - A RESOLUTION OF SUBSTANTIAL <br />COMPLIANCE - HOYLE ANNEXATON (Continued from 5/15/01) Staff <br />recommends continuance to 6/19/01 <br /> <br />Davidson announced that at the request of the applicant, Staff recommends a continuance <br />of this matter to June 19, 2001. <br /> <br />MOTION: Davidson moved that Council continue Resolution No. 27, Series 2001, to <br />June 19, 2001 meeting, seconded by Levihn. <br /> <br />Howard recused himself from the discussion and vote. <br /> <br />Sisk noted that Mr. Lopez was in attendance earlier in the evening. Sisk asked if the <br />continuance was at the request of the applicant's attorney, Mr. Lopez or Staff. <br />City Attorney Light confirmed that the request was that of the applicant's counsel, Mr. <br />Richard Lopez. Light stated that the City received a letter, from Mr. Lopez, dated May <br />18, 2001, asking for a continuance to June 19, 2001, to set the hearing on the annexation <br />for August 7, 2001. <br /> <br />Sisk clarified for the record, that the request for a continuance was made by the applicant <br />and not by the City. <br /> <br />VOTE: All in favor. Howard abstained. <br /> <br />APPROVAL OF LEASE OF REUSE WATER TO THE TOWN OF ERIE <br /> <br />Public Works Director Tom Phare reported that the Town of Erie desires to lease surplus <br />reuse water for irrigation purposes for their newly developed golf course along Highway <br />7. He stated that Erie has made several inquiries within the area, and has approached the <br />City of Louisville and discussed terms, conditions and availability of leasing reuse water. <br />Phare reported that through negotiations, an agreement was written to lease reuse water, <br />which comes from water rights that are not fully consumed. The City would have the <br />right to be reimbursed up to $200 per acre-foot of water provided to the Town of Erie, or <br />a one-acre foot per acre-foot trade of wet water.
